Hi Gurus,

I received the following RFE; Gurus please give your valuable answers. Mine’s is a labor sub and I140 approved on 01/24/2005.

Questions:
1. My attorney don’t want to mention “the position’s educational and/or training requirements” in the employer letter, he is saying it is general?
2. Once I140 is approved. Do they check again the labor is a match? If so what are chances of denial?
3. Is this a simple or complex RFE?

RFE: The letter must describe your employment, including your job title, the specific duties of the position, the position’s educational and/or training requirements, the date you first began employment and the wage/salary paid. Any such letter must confirm an offer of permanent employment and state whether the terms and conditions described in your employment-based immigrant visa petition continue to exist.

It is a standard EVL RFE. However, you need to put position’s educational and/or training requirements in the support letter. It will be like "this position requires Master Degree with 2 years experience or Bachelor degree with 5 years experience" something like that. Check your labor.

This is a standard RFE. Nothing to worry. They just want to ensure you have a job and that it is meeting the requirements specified in your labor certification. Good Luck with your reply.

By the way, is your case EB2 or EB3 ? From India ?? Thanks
