I need help desperately : what to do in this case. :confused: :confused: :confused:

Labor PD : May 10,2001 (Subs)
I140 RD 1/12/2005 , AD 3/7/2005
EAD RD 04/26/2004 AD 5/7/2005
AP RD 04/27/2004 -- AD ? ???
I485 RD 1/12/2005 -- AD ??
I got Laid off on 7/15/2005
I need to travel outside country. The H1B stamped is valid till 04/19/2006
I am getting married very soon. My fiancee is outside the country.
What are the option available for me to get married to some one outside this country
One lawyer suggested me ----- while your AOS is still in process , your future wife case can be included as part of your GC processing . I can wait for 485 approval while your future wife can appy consular processing which will hardly take 3-4 months ?
i do appreciate helps from experts/Gurus out here

If you are in EB3 and getting married before Oct 2005
- Find employer who can transfer your H1.
- Your wife (future) can apply for H4 visa.
- File 485 for her when she comes here.

My Suggestion

Hi,

My advise is.

Try for another oppartunity and apply for H1 through preimum processing.

Ofcourse it will take min 3 -4 months, to get job and H1.

Get married and go for stamping for your wife H4 visa in India.

Once your wife come back to US on H4 visa, apply for I-485 for her.

You do not know how much time it will take for GC.

Atleast you both can stay together while the GC in process

First of all , you're out of status now, either if you look from H1B or pending AOS prospective
If you leave the country , they'll not let you come back (unless you lie to the imm. officer at the port of entry)

You have to find a job ASAP and then transfer your H1B status. (pay the premium processing , whatever) .


Once your status is OK, your visa will become valid again and you can travel and marry.

In theory , once you get a job, you may send the AC21 and don't transfer your H1b, but travel using the AP (and work using the EAD).
But in this case you'll not be able to bring your wife easily.
(Depending on your luck it will take from few months to few years)

:D Go to sulekha.com and get a H1B broker ,transfer ur H1b otherwise u won't be able to bring ur wife.Regarding you give job to H1B broker not they to u. :D Once she enters US ,just file her 485.If u have some surplus dollar,apply for premium.Try to maintain ur H1B as long as you are bachelor.
