here is my history:

EB3 - Sep 26,2003 RD for I-140,485(Concurrent) - Sub Labor

I-485 RFE : Nov 12, 2004 (RFE was on I-140 ability to pay)
RFE response received by USCIS - Dec 21, 2004
I-140 AD: 01/07/2005
I-485 pending

I have 2 options regarding my job situation now. i have an immediate job offer that has been waiting for the last 6+ months --- have pushed it out till the limits...trying to decide if i shd hold on for a while more or jump the ship now!

Option 1:
Use AC-21 right now since the new memo says no concurrent adj

Option 2:
Wait for I-485 to happen - because some EB3 concurrent cases are coming thru last 2-3 days and moreover the RFE was issued on my I-485, so they r likely to 'decide' on 485 within 60 days from Dec 21 .

Folks, give me some input on which option i shd take --

thnx in advance - MJ23

---- Your I-140 is approved
your I-485 was filed on September 2003 and still pending, you are eligible to use AC21 if the new employer is ready to give you future permanent job offer letter with same/similar job duties as on approved LC (or the LC that you substituted)

Similar situation

Hi
My situation is:

My I-140 was approved. After I-140 approval, I've submitted I-485.

180 days (after I-485 submission) are coming soon.

My new employer is ready to give me future permanent job offer letter with same/similar job duties.

I am going to use AC-21

My question is: Do I need any letter from my old (actually current) employer?

Thanks in advance

-----NO ,if poosible try to ask the approved LC copy particularly the form ETA750A it has your job duties in item 13 on it if you get it then it will be very simple to draft AC21 letter with same/similar job duties, the LC copy may be with the Lawyer and he may not give you if you tell him that you are going to change the employer. use some trick and get the copy of approved LC and I hope you have your I-485 filing reciept with you
Thanks in advance

Thank you Ginnu

Thank you, Ginnu, for the quick reply

Yes, you are right.
LC copy is with the lawyer.
What I was able to get - copy of letters from my current employer (which were sent to the lawyer) during the I-140 outstanding researcher preparation. Those letters describe my job duties, so the lawyer used them to prepare LC.

In principle I dont see too much of a problem if to use the same lawyer for the A-21 preparation.

The trick is, if this lawyer has to inform my current company about all details of my future job or not. Hopefully not.

Another question for you, Ginnu.

Because of the financial difficulties, starting from now, my current employer cant pay me the full salary. They are going to pay me just hourly (just symbolically). Thats why I am looking for the new job.

Can this period of low (symbolical payment) affect green card?

My I-140 was approved in June.
And I-485 was filed on Sep-15 2004.

Again, great thanks for help

Yours, Mode
