Gurus,,,Any one got approval with using 180 days rule

Hi Gurus,

    Please tell your opinions/views on 180 days ruls. I got RFE from VSC requesting employemnet letter (date of hire,salary,duties,prospect of continued employemnet) and earning statement for last 3 pay periods.
I changed jon in Feb-2001. I filed my 485 in Mar-2000.

Do i need to submit letter+pay stubs from new employer or old employer.(old employer may give only letter. I have pay stubs till feb-2001 with old employer If i send letter from old employer+old pay stubs till feb is it o.k.?

Please shed some light on this issue.

Check with your attorney. If you dont have your own attorney try to contact Ron Gotcher or Sheela Murthy. Both of them seem to have a handle on this.

Does your RFE ask for this information from your "current" employer or "sponsoring" employer?

You should be ok as long as your sponsoring employee is willing to give you an letter offering employement in the similar occupation. Your current pay stubs should be fine. There are no clear guidelines on 180-day rules and it is all case to case.

Since your RFE asks for letter from current employer, you "must" supply a letter from the current employer. This might qualify you for benefit under the 180 days rule. To be on the safer side, you might also want to provide a letter from the sponsoring employer, indicating their continued interest.
