greencard through marriage

Hi,

My name is Leopoldo and I have to 2 things to say (ill do my best to explain)..hopefully i can get a little help here :o...

1) I came in here in the U.S. as a k-2 back in October 17, 1992 (I believe I came in here legally). I am now 27 yrs. old but i never gotten my greencard. Ive been living here for that long, even went to school here, gotten my High Scool diploma..but never worked. My mother came in as a K-1 and got her greencard back in 1995. My step Dad (not with my mother anymore) and who got us here, for some reason, never finish my documents..and thats why i havent gotten a greencard eversince..anyways.. its very complicated for me to explain because theres too much confusion to this sitautions..I would say it was a huge miss apportunity of not getting it done right way, I am sadden and devasted when my mother told me about it, my mother didnt know anything about immigration proceccess then, now that we sorta know, we are stuck and having problems obtaining a greencard.....moving on..
by the way..i do have a social security number but not valid to work...


2) I have a girlfriend whom i know for nearly 10 yrs, we met in High School, had a on and off relationship with her..she's been there for me with this confusing situations im having..we are now both planning to get married soon. She was born in the Phillipines but became a U.S citzen here. So, with all this confusing story i just said, i guess i have a couple of questions or so..

After I marry my girfriend,
- How do i apply for a green card?

- since i came as a K-2, will that affect any of the process?

I know for a fact that K-1 can only AOS based on marriage to their sponsor. You came here on a K-2. I am not too sure, but I think you cannot AOS any other way either. Since you never AOSed after your mother's marriage, you may be in limbo. You have overstayed long enough for the ten year bar to kick in. Please consult a competent attorney.

You would need to file couple of forms after a marriage, pay the fee and wait. You will be in a process. Either you are legal or not, in almost all cases the conditional green card is approved by USCIS.
