Greencard not here yet, OK to leave?

My uncle, his wife, and their daughter came to the US on 1/22/06, via my mom's petition. So they've been here a little over a week. But their daughter needs to go back to China for school on 2/14/06 and the greencards haven't arrived at our residence yet. She has the alien number written on her Chinese passport, is that good enough, assuming that the greencard doesn't come before she leaves? Also, if its ok that she goes back to China and can come back without the greencard, what happens if there was an error on her greencard (ie fingerprint was blurry/messed up) and the US government requires her to go to an office for a re-print. But she won't be able to do so because she's in China. Thanks!

that,s called advance parole,is a travel document, and in ur case, those guys are here on immigrant visa, so they should have a temporary i551 stamp in thier passport right on arrival in the u.s, which reads EVIDENCE OF LAWFUL PERMENENT RESIDENCE.check the passport if they got it, then no problem, she can go back to china and u can send her the green card when is ready,BUT remember a green card holder is not allowed to stay out of the u.s for more than 6months.if u wanna stay more than 6 months u need a re-entry. good luck

Oh, k, thanks. But I thought a re-entry permit was only required if you stayed 1-2 years abroad? ANd what if we send the greencard and it gets lost in the mail?

I agree with yahayajp....their passports ought to be stamped?I know all immigrants have their passports stamped and then when they get here they get the actual green cards..if her passport is stamped i don't see why she cannot travel to China and have the card mailed to
her when it comes..

If its that urgent you need to go to the local INS office with all the documents. They will tell you if there is a stamp on passport or not and they can issue you an interim Advanced parole if you dont have stamp on passport.
So nothing to worry. Relax and calm down.

Good luck.

The thing is that the embassy in China told my uncle that the greencard can take up to 6 weeks to arrive, they arrived here on the 22nd, and the 14th is only about 3 weeks away from the 22nd. So we're worried that the greencard may not get here in time.

Did you check their passports and see if they have a stamp I-551? They most since they should entered here with a visa right? That is the first thing to do. If they have the stamp is okay and they can travel with it, but they can't stay too long outside the US with it.
In the other hand since you are talking about re-entry permit, will your cousin stay in China for more than a year? If that so then she should wait for her card instead wait for it on the mail. And definetly they need a re-entry permit if they going to stay longer.
And Advance Parole is not needed and won't be issue since they are already permanent residents.
Good luck,

on the US Visa it says "Upon endorsement serves as temporary I-551 evidencing permanent residence for 1 year."

what type of pictures do we need for the reentry permit? the I-131 form says that the person must show an ear but I thought I saw somewhere on uscis.gov that it just needs to be a frontal picture.

So the I-131 form is wrong about the showing of the ear in the pictures? Also, on the I-131, Part 1 #3, it says "Class of admission," what do I put in that box?

Ignore the instructions on I-131. The updated instructions are available on the link i sent you.
