Green Card w/ Tourist Visa

She came on a tourist visa. We were in a long distance relationship for about 4 years and during that time, I visited her twice. We didn't know when we might get married. Last year, She came here to attend my college graduation and stayed at her autie's home, but we didn't have an idea we'd get married, but did so after she was here more than 2 months. I just didn't want to have a long distance relationship again so we decided to get married. We contacted a lawyer and he advises us to say that we met last year at my graduation party. He told us INS doesn't want people getting married on a tourist visa. Is the lawyer giving us a good advise? Its like telling a lie. Have anyone know any case similar to us? PLEASE HELP! BTW, our interview is scheduled on the 27th of feb.

I wouldn't tell lies, I think it's a bad advice. Tell it how it is, nothing wrong with that story in my humble opinion.
It's pretty much how I came here, on a tourist visa waiver program to visit my long time online friend. After we found out how good we "click" we decided to get married shortly before my visa expired. By now I'm in the middle of the progress to become an LPR.

If he tells the CIS officer that they had been in a relationship for 4 years before she arrived in the US and eventually got married to him, the officer might (and has every reason to) suspect she had the immigrant intent when entering the US on a strictly non-immigrant visa. And that would probably raise problems....
 
There is nothing to worry. To know a person for so long and then marry is nothing wrong at all and there are many cases over here in B1/B2 with the same issue and were succesfull. And the part that USCIS doesn't approved that people in B1/B2 visa doesn't marry and apply for AOS, is not true if that were the case then they should put in the law that a B1/B2 visa can't apply for adjusment of status. It depends how that happened, many people apply just for B2 visa to enter and immediately marry THAT is totally different and is not good.

There are rules about it, since B1/B2 visas are not dual intent.
As long as you didn't "plan" to come to get marry there is nothing to worry, normally they apply the 30/60 day rule.

I don't think he was that worried about the B1/B2 visa and the 30/60 day rule, he was just wondering if he should tell the whole truth, or just omit the part about them having known each other for 4 years. There's nothing wrong about being a B2 visa, and applying for AOS, I am a B2 with a gc in hand ;)

To the OP, i think the fact that you guys waited for 2 months to get married is good enough proof that she didn't come here with the intent to immigrate. And link sometime2006 provided is very reassuring about the issue. The proconceived intent is not enough grounds to deny an application, as long as everything else is in order :)

Nothing wrong with knowing a person for so long, then coming to the US as a tourist and finding out that there's more, eventually getting married.

That's how me and my wife started. I, for one, have no intent to hide the truth.
