Hello all,

I have posted about this before but my situation is little different now. Please help..

Here is my situation:

I got married to US Citizen in July 2004 got my 2 year green card in March 2005 the 2 year card interview was on Jan 2005 and she filed for divorce in December 2005. We started working things out and she was still living with me i have all utility bills/rent insurance etc until the time i got 10 year card. She did not tell me this but she followed up with divorce on Sept. 2006 but she signed my documents in December 2006 so i could apply for 10 year green card and i applied for 10 year green card and my conditions were removed and got my 10 year Green Card in March 2007 but then after 2 months later May 2 2007 my divorce got finalized and we separated.

I have the divorce document where it states that she filed for divorce Sept. 06 but the separation date on the next document states we separated Feb. 2005.

Now, my question is its already been more than 5 years..Should i go ahead and apply for Citizenship? i am just afraid.

NOW MY SITUATION HAS CHANGED A BIT

I have just gotten married to US Citizen 2 months ago. I have not register my marriage yet because she goes to school and with my income it will be harder for her to get financial aid. But Do you guys think it will be better to apply for citizenship now? My lawyer states that even if they look into your divorce documents and reject your citizenship you can always get it through your current marriage.

Any help is appreciated....

Hello all,

What your lawyer said is just an opinion, there is no GUARANTEE USCIS will grant you a green card based on your new spouse assuming the previous one is voided. You need to get the divorce date corrected. One document says one thing and the other says another.

What do you mean the marriage was not registered? It was only ceremonial, with no legal procedures? If you're legally married to her, it would be fraud for her to pretend that she's still single while collecting need-based financial aid.

Yes, it was only ceremonial and if i am going to apply for Citizenship i will be registering it for sure and she only has a semester left anyways. Regardless of this situation Please advise that should i apply for citizenship because of my divorce finalized 2 months after getting the 10 year green card. Will i have any trouble of loosing my green card.

thank you all for help.

Thank you very much for your help.
