Green card through kids?

This question is for a friend of mine. He is obligated to pay child support although he doesn't have work permit. Last year, he lost a very good job and having a very hard time finding a job that pays well. He was refused by the court when he wanted to reduce the payments because the court thinks that he is capable of earning more. He said the judge keeps streotyping him (typical father who doesn't want to pay anything to his ex-wife). My first question is can he tell the family court about the actual reason he cannot get better job? He says if he leaves by getting deported he will never see his sons again.

Also can he take this to the federal court? Is it too bold to say that a parent who is obligated to pay child support by a state court should be given work permit? That way parent of citizen kids can make the money they are capable of earning. Nothing bad will come from this.

There is no basis in law for such a claim, so taking it to federal court would get nowhere.
