Green card through family and employer

Hello,

My employer is beginning the paperwork for my greencard with the first step, labor certification. In the meantime I am also trying to start the paperwork on my own based on family since my husband is a US citizen.

My question is: Could I have two applications for permanent residence going on simultaneously?

Is there any harm if labor application is filed through my employer and I file I-485 separately on my own?

Please provide any input you have. Thank you very much.

Hi there and welcome to this great forum!

I'm sure an expert will chime in on your case soon, but I don't think there is an issue if you have two apps in at the same time, but I would likely think that the family based one will be much faster, because of the immediate assigning of an Alien number. You can also apply for an EAD which may render the need for a labor cert useless. But there are many more people who will know better than I. Best to read the USCIS guide on How Do I Become a Permanent Resident and work through that and all the forms slowly and carefully.

Hope this helps!
