Green card Through Brother

Hi

This is my second question for the forum.

My brothe ris US citizen. What help can I have through him in getting Green Card earlier when I go for J1 waiver...like should I apply for gren card through him(and may be evn now...as I am still in residency and going for fellowship)...instead of applying when I go for j1 waiver through my sponsor(the one I would work for)

And I was reading about Priority Date?.. Can I apply now itself so that I can get earlier priority date as I still have few years before applying for waive job??

Any input would be highly appreciated.

He can file form I130 for you and sponsor you for a green-card. However, the waiting time for that is 14-21 years, unless the job market for physician tanks you are much faster to get your GC through the employment route.

I would advise against having him file for you while you are still on J1. Filing form I130 means you have 'immigration intent' which can give you trouble when going for your J1 stamping.

The priority date determines how long you have to wait for your GC. In the 'sibling of adult US citizen' category this waiting time is 14+ years.

In order to secure a priority date, an employer has to file an application for labor certification (or PERM) for you. Unfortunately, that can only be done after you fulfill the requirements for the job, typically that would be completion of residency.
Most people have someone file while they do their waiver job. Either their waiver employer, or someone else.
 
It appears to me you are on a J-1 visa now doing your residency and fellowship. You can go back to your home country for 2 years (as required by the J-1 visa) and come back to the USA with an H-1 OR you can get a J waiver job.
I don't think you can get your GC thru your brother or even by marrying an american citizen.
It is a long journey to get the GC.
