As a green card holder through asylum,I would like to know if I'm entittled to bring my son to America as a resident, through the following-to-join benefit?

Why didn't you bring him after you were granted asylee status? Why did you wait until after you get your GC? Is your son under 21 and unmarried (at the time of your asylum approval or at the time of GC?)

When you were granted asylum, you had two years to file the paperwork to bring your son to the United States as a derivative asylee. He would not have been subjected to any quota and could have arrived pretty quickly.

Now you have to wait about five years before he could come.

After my asylum, my son (8 years old at that time, 13 today) was granted the right to come as asylee, but her mother was not able to come to America and she didn't want to live separeted from her son.

I know my son, is still able to use his derivative asylee approval letter any time while he still be single and under 21 years old, to come as derivative asylee, not as a green card holder.

But my question is enterelly diferent...Can my son receive Green Card, as following-to-join on my green card? If that is the case he will become in a legal resident with no waiting time, because he is receiving following to join benefits.

All your ideas are welcome...thanks in advance

In response to your last question he CANNOT come on the basis of your green card approval. He can file an I-130 on his behalf. This process takes about five years.

what is the problem? Just let him come over as an asylee.

Man,your son will have to apply for Green Card.If you were naturalized, your son would be automatically US citizen. But this special law doesn't apply to PRs.
