Green Card processing while in Grad School

Hi - a quick question. I am currently on an H1-B visa and my employer is about to start my green card processing. However, I intend to go to graduate school in 2004 and and hence will most definitely not receive my green card by fall 2004.

I have been told by my company immigration dept that when I go to school, I would have to be on an F1 visa which causes a conflict with my green card application. As a result, I would either be denied the F1 visa, but most likely I would be given the F1 visa and my green card processing with be terminated. They also said that the green card process would have to be started all over again when I return from grad school.

Is this true? Are there any work arounds to this? I will be attending school full time and will not be on my employer's payroll.

I am doing my master program while I work with H1-B and I-485 waiting.
Can a H1-B study together with working in a company?

Not true?

If you have a valid H1, you dont need to switch to F1 to study. You can study anywhere in any program. You dont even have to go thru International Student Office.


Millions of people are workinig for a company and doing their higher degree at the same time. Make sure you dont hamper your work while studying. You can go Evening school. It all depends on you and your employer.

Not only H1, also h4 can study in this country legally without changing their status to F1.


But you have to work full time to keep your H1B as a rule. If your green card is under proceessed, how you quit the company. You can only switch job under AC 21.
