Hi,
I got my greencard in 2002 July. Now I am planning on getting married to a girl living in India. SHe got a H1 and she is coming to the US. I will be eligible to apply for a citizen in 2007 Jan. Since she will be having a valid H1 till 2007 Jan. Can I get amrried to her now and apply for adjustment after I become a citizen? What will happen if she is out of job in the meanwhile? Cnan some one help me out with this Please?

Hi,
You have 2 options :
a) She maintains her H1 and remains in US till you file her I-130 after you become a citizen . If she looses her H1 in the middle, she is out of status.
b) You file for her I-130 now using your GC but she still needs to maintain her H1 till that I-130 is approved (that takes 4-5 hrs now). If she looses her H1 in the middle, she is out of status.

I don't think it is that easy. Right now if a green card holder marries a non green card holder it takes like 8 to 9 years for the spouse to get the green card. That is the reason I am looking if there were any changes.
 
I am looking fro a better way. All whaat I see now is either marry a girl that comes to USA recently on H1 and meanwhile if you get a citizen convert her to your status. Else marry a girl in India and wait for 8 years. This sucks.
 
So if you get greencard how long it is going to take to get citizen ship, What will happen if he is a citizen and marry a girl on H1B1 visa.How long it will take to change her status to change from H1B1 to citizen....
 
once you get a green card then with in 5 years you are eligible to file for a citizen. If a citizen marries a h1b visa holder then he can get a green card to his spouce in a year I think.
 
Can you please make it clear..How long does it take to get greencard if H1B1 holder marrys a Greencard holder in the USA???
