There is no new law. An I-130 filed by a LPR who is a former asylee is processed just like every other LPR submitted I-130-in other words a long wait.

Thank you Thankful. But is there any Green card holder asylum based who got an I-130 approved at this time or in the past?
 
My understanding is that you have to submit your I-130 not later than a year from asylum granted or before. BUT, I'm not sure if thats true.

You are right. Sorry, I was confused. Green card holders can make a petition for spouse and children.

What are you really asking Victoire?

I-130 cases are filed all the time and get approved all the time (and from time to time get denied).

If you have the requisite relationship, file the form and get yourself in line for one of these rare visas. The line is already long as it is.

The fact that you are an asylum-based green card holder makes no difference to the USCIS. You file your I-130 on behalf of your relative (say your husband or wife), get a priority date as the date of your I-130 and then wait forever (meaning five to six years) before that person can join you.

What else do you need to know?
 
Does anybody know howlong the wait is exatly? Is is more reasonable to file I-130 with green card or wait till one become a citizen and then apply? does it make any difference to file based on GC and later update it when we become a citizen???

I think you have dealt with the immigration system long enough to realize by now that there is no such thing as an "exact" timing in this field. It is currently taking five years.

It is common to file as a LPR and then "upgrade" the petition if and when you naturalize.
