I'm a 10 year green card holder and my husband recently divorced me July 2, 2008 and still now in processed. I have received a Summon Divorce complaint and was given 21 days to answer his summon divorce complaint. My green card was approved just recently this April 15, 2008 and my husband hurriedly divorced me July 2, 2008. We have arguments every now and then and we cannot get along well. Our divorce is uncontested because I signed a post nuptial agreement as I don't want to be included with his debts and loans which I didn't incurred and have nothing to do with that. He has five grown kids from ex-wife and we don't have child together. His goal are for his grown children that's what we argue most of the time, getting loans and big amount of money. That day, July 2, 2008 we argue about him buying a house and lot for his grown children as he believes when he dies his children has no where to live and he pitieth his children. He don't have any plans for me as he say I can still remarry when he dies. That's how he always tells me every now and then that his assets, house, money and everything are for his children and none for me. So what I did to shut my husband and his relatives and grown kid's mouth up I signed a post nuptial without getting anything when he dies as I'm not after his money or whatever. In fact, he don't have anything, this house is not yet fully paid, our bank savings accounts is negative balance due to his loans and debts so what I did it's better for me not to have joint savings account with my soon to be ex husband rather than I'm included with his debts.
And now our divorce will be finalized in November 3, 2008, my husband complaint is due to irreconcilable and it is an uncontested divorce. Anyway, I also agree so I can move on with my life as I have no future I will wind up beggar in the US taking care of him and giving my whole life without nothing as his goal are his first family from ex-wife. He told me that black don't have future in this earth that's why he pitieth them and buying them house and lot. I will wind up burried with debts which I didn't incurred that's how we argue on that day and ask him to divorce me so I can live my life free and can able to move on without him as I am living with him like a housemaid with no salary. It's better to move on without him and find my own future.
Now I'm worried because I want to file US Citizenship after two years (divorced 5-year residency) and the immigration officer can see that I just received my green card April 15, 2008 and husband filed for divorced July 2, 2008 I don't know yet when our divorced will be dissolved as we have to attend hearing.
I answer the Summon Divorced Complaint of my husband eventhough I don't have demands like alimony coz it's already stated in our post nuptial no alimony, and even attorneys fees I'm going to pay for my own. So I don't have a choice I will just sign and consent the Divorce Complaint.
I draft an answer only to make sure that I'm not included anymore with his debts, loans with credit cards, banks, credit union. I want to make sure I'm free and out of debt and I'm also asking for my husband to help me with my health insurance and that's it.
My question can I include a brief summary of our relationship like drafting a history why we argue and irreconcilable. I know the judge will not hear anything as it is uncontested. But I just want to have my husband's attorney and the judge to read my side why we divorced and have his attorney received a copy of our marriage history so that when I file my US Citizenship after two years I have a proof that our marriage is not a sham. My husband just rushed our divorced after 2 and a half months of gotten my green card.
I'm just worried because I read about recently got green card and divorced and disapproved for US citizenship. What will I do. And my next question is: Can I travel abroad and come back again to US? They say that since I'm divorced, the immigration officer at the airport will going to interrogate me about my resident or home address is that true? Can they allow me to enter US after travelling to my home country? Is there anybody here who are divorced (who came in the US as fiance visa and got 10 year green card) who traveled abroad and had a hard time to enter back to US.
