This is my situation. me and my wife we are in the US with a O1 visa. The visa will expire on January 2005. I have a brother who is a US citizen, can I fill the I-130 form and stay in the country until my pettition is approved?? Help me please!!!!!

he can fill I-130 for you, but you will have to maintain your own non-immigrant status until his petition is approved and an immigrant visa number is issued to you. That will take about 12 years. Read www.uscis.gov
