Green Card for Sister...

Hi,
I have filed a I-130 for my sister for the GC. Once my sister gets her Green Card can she get her son/daughter to US for higher studies. In other words can she file for GC for her son and daughter.

When she gets her green card, her husband and minor children will also automatically get green card. However, It will be several years before your sister gets her green card depending on her country of birth.

Thank you folks your replies, she applied for I-130 in the Dec 2006, i guess it will be some time when she gets her GC. Based on what you folks are saying her family members (husband,kids if they are minor) will also get GC right. Should the kids be below 21.

In order to qualify for derivative green cards her children would have to be under 21 when her case is ripe for a consular interview (around 2017*), with some allowance for them being a bit over 21 based on the CSPA adjustment.


*sometime after 2020 if she's from Mexico or the Philippines
