Green Card for my children !

I am a former Asylee and now a Green Card holder. My 12 and 8 y/o daughters just arrived to United States. Should I fill out I-485 forms for both of them and send it out, in order them to get a Green Cards ? Any answer or suggestion will be appreciated. Thank you.

Tamo, how did they get here? Did they come with a turist visa? I think you need to file a I-130 not a I-485.

Lets wait and see if someone else can answer better.
 
Hopefully they are here as under relative on asylum baed on I-730 you might have filled? I hope so. You will have very difficult time if that is not the case.Please explain what is exactly going on?

First of all thank you guys. Yes they received visas based on I-730 and there are here now ! What do I do next with them ?? Thank you again !
 
They can apply for GC after 1 year of physical stay in USA

Update: Sorry, didn't notice the ages... they can apply for GC now

They can apply immediately based on the fact that they are children of principal "you" applicant.

you can find it in the I-485 instructions, I attached a copy and highlighted it.

If the spouse or child is in the United States, the individual derivatives may file their Form I-485 adjustment-of-status applications concurrently with the Form I-485 for the principal applicant, or file the Form I-485 at anytime after the principal is approved, if a visa number is available.

you already have GC in hand, so you can file anytime ... "if visa number is available" GC cap has been removed from refugee and asylee.
 
This is completely wrong. They have to wait for one year after getting in under the I-730 approval before they can submit their I-485 applications.

You are mixing apples and oranges. This language you quoted does not pertain to asylum cases.
 
No consideration for being under age "child" with a parent carrying GC? Nothing mentioned to exclude asylum status.

consideration? Well, the consideration is that the spouse and the children are allowed to enter the USA as asylees without regard to a quota system. That is pretty darn good consideration.
 
I didn't mean with "consideration" a sympathetic meaning, I was referring to the legal immigration point of view.

a parent with GC + 2 kids residing in USA
 
Asylee and their relative can apply a year after physical presence in US if approved regardless of their age even though parent might have became GC holder before or after their arrival because base is asylee and kids were mentioned in asylum application as relative.They will be under same catagory and need to wait a year to apply.This is same for refugee and the only diffrence is refuges GC will be backdateto arrival date if adjudicated and asylees will be backdate one year.

So the correct answer will be to wait one year Right ? I was going to send I_485 for them already :)
