i have a friend whose mother had filed for Green Card for him. the mother is a green card holder herself. however he got married afterwards and later got divorced. would he still be eligible to obtain the green card seeing that his marital status has reverted to single.

Yes, he is fine as long as he was unmarried at the time of application and if he is unmarried at the time of processing. He can receive immigration benefits based on I-130 petition.

Wish you & your friend all the best!!!

When he got married, the petition was voided (although USCIS may not have actually voided it yet because they don't know about the marriage yet). Sorry, getting divorced doesn't reactivate the petition. His mother has to file a new one.

He will not get his green-card through current filing. To be eligible for F2B category, the beneficiery cannot get married until he gets his gc. If you read DS-230 form carefully only option available for signle is single (never married). So once you are divorced, u r no more single..u always be counted as divrocee..

hope this helps..
