BACKGROUND: I've had my present green card for five years. My first one was from a company and by mistake I let it expire. During the time of the first one I married and had children here in the USA. The second green card was issued because I married an American in 1998 and had children in US....got the card in 2000. QUESTION: We are now divorcing, can she get my green card taken away?

I agree with RealCanadian: I don't think you have anything to worry about.

I am curious, however, what you mean by saying that you let your first green card "expire" and had to get another one through marriage. Are you sure that you even lost your GC status that you had under the first green card in the first place?

In most cases in order to actually loose the GC status you'd need to move out of the U.S. However, you say that you got married and had children while still in the U.S. and while still under the original GC status.


If you simply did not renew the plastic green card on time, it does not mean that you lost your permanent resident status.
