OK. This is where I am. The senator angle didn't work out. They just reiterated what the USCIS I-485 rejection letter stated that we did show up for the biometrics interview.
Tomorrow, Sept. 15, I will go back the USCIS office to see where we stand, see if there are any options or advice they can give to us. My wife's K3 visa is set to expire December 5th and the I-485 letter states my wife can only be in the US 33 days from August 27. My wife arives Sept. 21 and I have a USCIS appointment on Sept. 22. Can we still do the biometrics interview at this time?
This is what we need to do and I am not sure which way to proceed. We need to get the case reopened. If we can not do this by the 33 day notice I need to extend the periold my wife can stay in the US until at least until Dec. 5 when here K3 visas expires. Should I do the I-290B appeal now or until we meet with the USCIS and try to do the biometrics on Sept. 22. My wife is contacting an attorney right now but we have not head back.
We are getting conflicting reports on how to proceed with this. Thanks.
