Green card delayed for my mother. Status shows Acceptance stage for last 8 months.

Hi all,

I filed GC for my mother on AOS basis in Sep'12. She had finger printing done in Oct'12 and received EAD/AP card in Nov'12. Since, then there is no further update on her case on online case status website. It keeps showing "Acceptance" which is the first stage and it says "Your case is being processed at our NATIONAL BENEFITS CENTER location. You will be notified by mail when a decision is made, or if the office needs something from you.". It has been more than 8 months since it has this status.

Her service center shows MSC which is also known as National Benefits center. When I check processing dates online, it does not show me any dates for I-485.

I am bit concerned. Can someone share their experience and provide some suggestions please.

I forgot to add that I already called their customer service and also went to meet at their local field office using infopass. but they said it is with the benefits center in Nebraska. They did not provide any other info.

Is there anyone here in the same boat?

Did you submit all documentation for I-130 and I-485 (BC, Medical report, Affidavit of support, proof of US citizenship, marriage cert)

Yes, I did. I filed both I-130 and I-485 together and sent all the doc including the above. I have not received any RFE also.
 
When it is 120 days of the EAD's expiration, apply for renewal. That might prompt them to dust off the AOS case and start working on it again, especially since if they approve the GC itself before the EAD expires, they won't have to renew the EAD (which would be purely at their cost because there is no fee for the renewal).

I thought EAD/AP is valid for one year, which in my mom's case is in Nov'13. So, I will have to renew it if she doesn't get her GC by then. Yesterday, I checked the online status of her I-130. It shows "Under Review" status.

Is there anyone here who is going through the same pain?

Yes, it is normally for 1 year. I'm suggesting that you apply for renewal when it is within 120 days of the expiration date. 120 days before the November expiration date would be sometime in July (or early August, if the expiration date is November 29 or 30).

It is in their interests to issue the GC before the EAD/AP expires, as the GC approval would allow them to avoid the effort of processing the EAD/AP renewal and the costs of printing the new card.

Check the processing dates for I-485 with your local field office. If it is beyond your filling date then there is a problem. If it is beyond that date and since you already tried contacting the 800 number and the local field office with no luck you might want to contact the DHS Ombudsman. http://www.dhs.gov/ombudsman-case-assistance

I am glad that you finally received good news! I sent both of my parent's packages on Nov 6, 2012 and their case status is still as: Request for evidence review I guess I just have to wait? (I responded to their RFE right away) :(

Should I do something? or just wait?

More info: I became a US Citizen on Oct 2012 and both of my parents arrived here couple of years ago on a tourist visa which also expired couple of years ago but they never left the country.

Congrats sshah!!! I filed for my father on Nov 8 2012 and got EAD/AP in January. Status shows acceptance and the local field office timeline shows Nov 8 2012 (updated on April 30, 2013). Going by your timelines guess we need to wait another couple of months.

To clarify, your mom received teh approval w/o interview right? can you tell you field office? Appreciate any help.

Hi, there was no RFE in my mother's case. Also, I filed her AOS after I became citizen and she came here only after I became citizen. In my case the online status was always showing Acceptance status. I called twice to follow-up and talked with customer service rep. Also, I visited the local office. You also might try that.

Hi, yes I would say just wait. BTW, there was no RFE in my mother's case. In her case also, the online status was always showing Acceptance status. But, I called customer service number twice to follow-up and also visited the local office in person. I feel that after my second call to the customer service, they speeded it up. You also might try that.
