I was not sure if I have to post it here!!!!

I was with a company which started my Green Card. Filed my I-485 in Sept 2002. Got 140 Approved before that. One of the benefit when I joined the company was processing of GC for no cost. ( Have no document)

For my personal reason I had to change the company now - Initially he was threating to cancel my Green Card. Now he is asking me to pay $12K for Letting my GC Process to continue. Infact company Owe's me $6K which are due for more than 6 months.

What is the best thing I should do??

--- no problem for you, 140 approved and I-485 pending more than 180 days, employer can not revoke I-140 and I-485 belongs to you. You can use AC21

Now he is asking me to pay $12K for Letting my GC Process to continue.
---- nothing to pay, let him try to cancel the GC process or keep quiet and don’t reply to his email or letter
Infact company Owe's me $6K which are due for more than 6 months.

--- Make a complaint with DOL to recover the money
What is the best thing I should do??
----- Best option is nothing to do, don’t reply to his email, don’t sign any document and find job in same /similar skills, use EAD for new job or transfer H1 if you have recent pay stubs. Once you join new employer sent the AC21 and intent change letter to BCIS through your new lawyer

Unfortunately I dont have any evidence that he was threatening as he was doing this over the phone..

Think like a Lion King , if not watch Lion King movie.
Your employer is $ 6000-00 due to you and on top of that he is demanding you to pay for GC process. If I were to be in your place , I would have sued him longtime back.
Obviously , he is liable for the 6 months pay that will in no way be less than $ 20,000-00.
Take an agressive stand and send a letter thru a lawyer to your employer. No one can interpret or change laws as per their will.
I recently changed my job as my project came to an abrupt end due to overdues to my employer.I was planning on suing my employer if he was not paying my last 15 days salary but he did pay me full.
For suing him for your money he has to produce evidence that he paid you.You have a chance to threaten him.

guys, I am in similar position. I am thinking between reporting to DOL Vs hiring a lawyer.

I know their pro's and con's. Lawyer will charge a lot (30% goes to him and I pay 30% tax on my part). DOL is slow and will not concult for me and I dont know my immigration rights.

What is my position (immig wise) for the time when the company didnt pay ? Mine is about 7 months spanning 2 years. Any help is appreciated. A friend also told me to just send a letter to dol and they will take care of the rest.

Can you (or anybody else) also give your opinion of the immig status ? esp if this will be considered negative in the PR process ? I am hoping for AC21 from that employer. I had to pay him the amount since he was threatening (so I left him <180 days when he started asking more)
