anyone knows...
we as asylee are not allowed to go back to home country even after green card.then if we wan get marry to a girl from home country.what's are the ways.if she come here on non-immigrant visa ...chances are less to adjust her status cuz of intentionaly (immigrant) got non-immigrant visa.so can we go to third country and get marry there..? or there are any other ways...?
let's discuss on this..!
 
I hear you Paramvir1 ... coz of this asylee .. I feel like my right to get married the one I love has taken from me.

what do you mean by third country ?
 
third country mean...not our home country neither united states.
we go to some other country on visitor visa and see our finacee over there and get marry.then come back and file petition here in the usa.cuz getting us visitor visa is'n peace of cake for citizens of our home countries.
 
Paramvir1 .. let us say she got the visitor visa as in my case .. and she is here in the USA .. and then what ? can she adjust her status trhogh me ?
 
Dude asking another clueless person about what to do..doesnt make sense. GO call a lawyer so you can be quiet....I told you there is NO way unless she applies for asylum..Usually initial lawyer consultations are freee...Asking Paramvir who thinks that Marrying in a 3rd country could solve a problem..will confuse u more...not being rude but..!

well, as far as i heared; when a person comes on visitor visa he has to maintain the very essense of being non-immigration status as he promised with visa officer.but as he gets marry that mean he broke the promise and had prior immigration intentions.so immigration officer MAY turned down his petition filled by spouse.unless he shows this marriage was not planned .how he has to show this i donnt know.
 
paramvir...A visitor can come here and marry a u.s citizen and he will be adjusted...There is no problem in adjusting as long as he/she is in legal status. There are lots of visitors who come here and then file their fiance visa where they dont have to leave the country..the processing time is 3 months so its ok...But a GC holder can apply for a visitor after he/she marries her but the problem is he/she doesn't have a visa available..

So its not about marrying in 3rd country or visitor visa fraud..Its just if the person marrying is a U.S Citizen or not..Thats all it matters...
 
If the girl from your country , she can apply for asylum and her chance for approval is high coz her ties to you. This is what a lawyer said.
if not you got to go through the school process until you get your GC or CS, the point is to keep her status legal and to be eligible for a adjustment in the future ..

It is a dilemma but this is the price we have to pay as an asylum in this country..

my fiancee is back in home country.
she will go for interview for visitor visa on march30,2005.so she can come over here and we can get marry.and it's so hard to get usa visitor visa these days.and i told her so many times if you could'n get visa then our marriage wonnt b possible.and she start crying so loudly and insist that she will wait another 4-5 yrs for me.but that donnt looks better for both of our life.cuz am already 30.and am alone here.even after getting GC..it's not possible for me to do something.i have lost my father when i was here and my mom is too old and could'n even go there to see her.
so friends this is life of an ASYLEE.
i guess now we need another asylum from this mental torture...?

Paramvir1! I will give you a wise idea. Do NOT let her come for visitor visa. Instead try to bring her on student visa F-1. Visitor visas are strictly valid for 6 months. Even if you apply for one extension, she will be given another 6 months. But rules regarding student visa are such that you can prolong it as much as you like. First people do BSc, then MSc, then PhD...so on & so on.
So you can stretch F-1 visa for many many years provided you remain a student in school.

This is just my idea. I don't think that visitor visa would be much use to her unless you want her to apply for Asylum or something.
One more thing: US consulate are wary of giving visitor visas to youngsters (especially from 3rd world countries). However they are more receptive giving student visa.

Paramvir1 .. I am in your situation alone and can't Waite this CIS ridicules years .. my girl is not from my country and she can't apply for asylum ... but is easy to get F-1 for her ... but trust me this is not an easy choice . coz you will end up paying her school !
you know if she got visitor visa just go head and apply for asylum base on your case or separate ..

if not go to Canada , screwed this. paper easier and you can file for her in a year or less. that is the best idea
 
thanx friends for your nice views and advice.well ..am thinking once she is here will file her asylum.about student visa i guess it's long process but i will try that too if all other....!let's see what God willing.
