Green card application with criminal record..

Hi everyone,

I have been in the USA for 5 years. I got married a month ago. I'm going to file
my green card application in February, but I have a problem. 11 years ago I was convicted of a crime and sentenced for 1 year jail time. It all happened back in my country. Could it affect my application?

Tricky problem. USCIS generally consider any conviction with a year or more of jail time to be a disqualifying event. You may want to consult a professional, because you will need to declare this when you apply for GC. (e.g. police clearances)

What exactly was the crime? What is your status in the US right now? The visa that you used 5 years ago to enter the US, was that acquired after the 1 year sentence? If so, was that sentence mentioned in the DS-156? You may need a lawyer who has expertise in both criminal and immigration law.
