hey all. im still located in aust atm but plan on moving over to the usa with my sucessful dv 2009 lottery. prob being is that when i applied i only just started seeing my current gf and she had no plans of going ova as its a big move but now that we have been together 2 and a bit yrs she wants us to stay together and come ova aswell. this decision was only made lately afta i already had my own application approved. whats my best way of trying to get her a visa aswell so we dont have to break up???
 
If the DV based GC has already been approved and issued to you, you will have to apply for her GC after marrying her just like any other GC holder.

would i be wise then to take her ova with me n marry her in the usa and do all the visa stuff ova there as i cant see there being enuff time b4 i leave to do it here. i read somewhere where that can issue her a temperary visa until hers can be assessed???
 
If you file papers for her while you only have a green card, she will have to wait some 4-5 years to become eligible to stay in the US based on being married to you. If you were a citizen she wouldn't have a long wait like that, but it will take 5 years for you to become a citizen.

While you wait those 4-5 years, she could explore multi-year visas like student visa or work visa, if she has the qualifications for either. But if she's going to get the student visa, she should not marry you until after she is already in the US, and she should not leave the US until you become a citizen or her papers come through so she can stay based on marriage. That is because people with student visas have difficulty entering the US if they are married to a US citizen or green card holder, due to the suspicion that they will overstay the visa to remain with their spouse.

would she have to apply for a student visa while still in oz or could she apply for it in the usa while here on a tourist visa? reason being i leave for the states in 8 weeks and dont want to leave without her. what sort of student visa could she apply for. she did start a business course last yr but deferred this yr in the hope that she could get a visa into the usa to be with me.
 
She can visit colleges and submit the applications to the schools while in the US, but attempts to switch from tourist visa to student status within the US are usually rejected.

So if she wants to study she should plan on applying for the visa in Australia at the nearest US consulate. First she needs to get accepted by an accredited college or university in the US for a full time program of study. Then once accepted, she would take the acceptance papers along with proof that she has the funds to pay for school (whether it's money from parents, scholarship, her own money, or otherwise) and apply for the visa.

Of course, if she shows you as her source of funds, she'll probably be rejected because they'll figure she's going to marry you and overstay.

If she wants to start the school year in August/September, it is already past or close to the application deadline for most colleges so she needs to hurry up. Fortunately, most schools allow starting in January.
 
yeah the above sounds like a plan. she can come ova for 3 months on tourist visa and apply for some colleges in the usa while im ova then come back to oz and submit forms to us consulate in oz sayin she is studying in the usa solo. is she able to renew afta 12 months for another visa if her studies are for 2-3 yrs etc??
 
what qualificatons do u require to study in the usa i guess i should have asked? shes not doctors lawyers material but was studying just business courses here in oz
 
To study in college for an Bachelor's (4-year) or Associate degree (2-year program that gives credit towards a Bachelor's), the minimum requirement is completion of high school. On top of that, individual colleges will often have their own additional requirements, usually including a standardized exam like the SAT or ACT. Some are more prestigious and competitive than others and will only accept people with excellent high school grades and SAT/ACT scores, whereas others will accept almost everybody who applies, and the rest are somewhere in between. She should plan to apply to multiple colleges, because acceptance is not guaranteed when they have more applicants than spaces.

cool thats awesum. yes she finished high school with pass marks. yes i thought she would apply for heaps of different courses to make sure she got into at least one. was it the study visas that someone said are rarely all used up meaning your almost guaranteed entry aslong as u have the funds and are a clean skin??? are u allowed a job on a student visa?
