Hi Guru,

I am working in the present company as a Computer Programmer for last 2 years. I also have 1-1/2 yrs of Mechanical Engg related experience in India.

The company is planning to file the labor for a position for me whose duties are 50% + different than what I currently do. It will consits of @ 60% work related to Mechanical Engg and @40% in programming.

We are thinking of filing EB2 with MS(Mechanical Engg) + 1-1/2 yrs.

My questions are:

1. Would there be any problems with this case?

2. Is there normally too much scrutiny for a labor filing as this (filing for dis-similar position)..Like Audit Review or RFE later on?

First write down all the job funtions both in CS and ME area, send to SWA to get prevailing wage. You will get PW based on the statement of works you submitted.

Nowadyas, many job posses multi functionality, so the PW go higher and higher.
