GREAT NEWS! I-140 approved after RFE response

Dear friends,

I would like to share this news with the fantastic people like you all in this forum!! Just now I got that TWO mails from USCIS saying that my I-140 is approved.

It was a labor substitution, got an RFE for I-140 for education evaluation and company's ability to pay. Responded to the RFE and got the approval in two weeks.

I am really happy to share this news with you all, as you all have been very helpful all through this period. United nations, jharkhandi, ETA-GC, and lots of others......!! Thanks thanks and thanks a lot.

Wish me luck for the next stage and I wish good luck to everyone in this forum for a fastest approval.

No Finger Print, No LUD change.

Congrats on getting your 140 approval. I did have one ? though. When you received the RFE was it both for credential evaluation and ability to pay. Was it one big RFE which had both of the above conditions.

could you please let me know about u'r ability to pay RFE, 'what they have asked for' and 'what have you submitted'? please elaborate little, I got the same RFE.

Bole_to, It was one BIG RFE in which they asked for both Credential evaluations and company's ability to pay!

prgc, they asked for my W-2 for last year, company's annual reports/financial statement. We submitted my W-2, latest pay-stubs and company's annual reports.

Even though it is Labor -Sub the priority date will in in 140 approval notice.

I have been following cases similar as ours(Labor substitution 1-140's @VSC on various Threads).

I think your Proactive role (Status Enquiry on the phone) has paid off.

I also have received an RFE for my Labor substituted I-140 and my lawyer is going to respond by this week-end.USCIS has asked for Original Labor Certification in the RFE.

Did you have any LUD's(with Status message change of "we have received your Reply, Blah Blah Blah) after your Responded to the RFE? How much time did it take for the Status Message to change on the I-140(if indeed it changed)?.I know you were asking this same bit of information from others.

Thank you very much vicky! Yes I know how important the LUD changes and what kind of curiousity it creates in candidates mind, because even I passed through that stage.

I-140 labor substitution
ND - Oct 21, 2003

LUD changed couple of weeks before getting an RFE
RFE isued on 08/10/2004

RFE responded on 23rd Aug, 2004
LUD changed on 25th Aug, 2004 with the message that CIS received the response

LUD changed on 1st and 2nd Sep, 2004 => no message change

LUD Changed and got approval emails from USCIS on 13th sep, 2004
LUD changed again 14th Sep, 2004.

I was tracking and noting down all these info with the mindset that it may be useful for someone in future.

I believe, as you said, initiating query for I-140 has paid off, which on the contrary the lawyers should have done.
