Sister came to USA on H4 visa in Nov 05 from India.She filed fro new h1B in May05.Her H1 visa was approved with start date Dec 06.It was new H1 and not change of status from h4 to h1.Is there any way to get change of status in USA (by filing I-539) with the approved petition.
The employer does not want to file another I-129.

It takes 3-4 months to get an appointment in India these days.Any suggestions?


How can she convert to h1 with the old petition without leaving USA?
 
Unless you request the COS at the time of H1 petition, it can be changed now. If you put another H1 it will come under quota ( Y 2007), she will not able to start working before Oct 1, 2006.
