Hi! After I leave a job, how long can I stay in status before I file the next H-1B? Any advise or guidance will be highly appreciated.

Jim, thanks for the reply. What about if I leave a job, then find another job within one month and file a new H-1B? Will my new H-1B get approved? Am I going to be considered unlawfully present in the U.S. during the two H-1Bs? If yes, is there any solution?

Thanks very much!

If your previous H1 has expired than you will be accumulating out of status days.
If your previous h1 has not expired , INS might take a liberal view based on the circumstances. Remember, you need recent 2 paystubs to transfer h1. So your latest paystub will serve the start of out of status/job . If you are out of status for more than 6 months, then you might invite 3/10 year bar from entering US.
