My wife (2nd yr resident) is in a similar situation as yogkc was. Here are the details.
2000 March - 2004 March - H4 visa
2004 March - till date - H1 visa
When their company lawyer applied for H1 visa, the lawyer requested visa till June 2007 and INS granted till June 2007 even though the 6 year H visa term is expiring in March 2006. Lawyer says not to worry and the status is legal. My wife does not have pending LC. Lawyer does not want to file for ammendment.
My LC is pending for long time, got 45 day letter and visa numbers are available. Therefore I am hoping that I'll get my EAD this year.
We are very much worried that if we do not inform INS we will be in big trouble in future. Our plan is to recapture time spent abroad, work till then, switch to H4 afterwards and wait for EAD. My wife may loose 2yrs in this process but we are ready to do that.
Can you please advice ?
