Got very diff. responses from INS to the last 2 status inquiries I made..

In the past 3 months I have made 2 status inquiries. My I-485/I-140/I765 and I131 was filed concurrently in March 2005 under EB3 lab. sub. and I-485 PD Oct 2000.

On August 16th, 2006 I received reply from the USCIS on my first status inquiry --

Type of Service Request - Case Status - Outside Processing time.
Based on your request we researched the status of this case. We are actively processing this case. However, we have to perform additional review on this case and this has caused a longer processing time. If you do not receive a decision or other notice from us within 6 months of this letter, please call....


Now today I received reply to my 2nd status inquiry which is as follows:

Type of Service requested: Case Status - Outside Processing Time
The processing of your case has been delayed. A check of our records establishes that your case is not yet ready for decision, as the required investigation into your background remains open.

Until the background investigation is completed, we cannot move forward on your case. These background checks are required to be completed on all applicants who apply for the immigration benefit you are seeking. We will make every effort to make a decision on this case as soon as the background checks are complete. If you do not receive a decision or other notice of action from us within 6 months of this letter, please contact our customer service number provided below.


But 2 weeks back when I talked to immi. officer she said that my case was stuck in one of the security checks??? But the reply I received today seems to very different.. I am totally confused as to what's happening to my case..

Experts please suggest as what all this might mean??... Has anyone else been through the same and have sucessfully managed to come out of it..

Does this mean that I might have to wait for another couple of years before I can expect to get approval even though it's been more than a 18 months since I applied for I-485 and my it's been more than 7 months since my PD became current... Please comment..

Aakash28: To clear your mind. The 3 background checks:
*IBIS: Interagency Border System. Instant check from several sources. If +, additional investigation takes place.
**FBI FP records. 10% with criminal record.
***FBI NC. Not related to FP check. Positive record doesn`t mean criminal and then goes to extended/additional review/investigation.

But Mr. Gonzalez said it makes no sense to blame the agency for a backlog in cases where the problem lies with another agency or when the applicant hasn't submitted all the information.
Of the about 1 million backlogged applications that are outside of USCIS control, 64 percent are for applications where a visa simply isn't available yet; 17 percent are for applications that are still lacking information; and 11 percent are awaiting an FBI name check. Another 8 percent have other issues.
 
I am just trying to figure out how much time did it took for people (who received similar letters) to get approved from the date of filing I-485 after their PD became current?? Has anyone who has receievd such letters been approved recently - please share your case details...just need some hope to hang in there..

But the immi. officer specifically said that I am not stuck in name check but one of the other security checks..
 
Aakash and others, I also received the "your case has been delayed . . . background investigation remains open . . . contact after 6 months" response from USCIS in late August 2006.

Meanwhile, my attorney had received a letter from Vermont in early August, which said that my case was delayed because of routine security checks.

I think these are just routine responses if your case is stuck in name check etc.

I have just stopped thinking about my I-485! Hoping that it will get approved sometime!

how did you learn all these backgraound checks? what will make it "+" in each check? can you give more details?

I had exactly the same two responses from NSC; 1) from the Acting Director and 2) from the service center (general address). I believe the first one was is May/June 2006 and the second came few weeks later. I do not remember the exact time frames. However, my AOS (plus my entire family) were approved September 14, 2006. Check my post in NSC forum.
