Got the email for the RFE being mailed. Need some suggestions.

Hi guys,

I told everyone that i am seeing some movement on the 485 application at NSC at this post :http://boards.immigrationportal.com/showthread.php?t=213138

I received the email today informing that they have mailed the RFE and i am waiting for that. I want some answers from you guys who have been issued such RFE and know about this in detail :

1. Do they mail the copy of the RFE to the employer ?
2. Does the RFE asks for any personal documents such as your Tax Records etc ?
3. Is getting RFE proves that your name check is not stuck at FBI ?
4. How much time it takes for the RFE to arrive, is it just the postal time required or they have some other processes to do before it is actually mailed ?

Please give me any other advise that you may think will be helpful to me.

What a pity. Your PD is april 2001 and your 485 RD is Mar 2004, and now you are getting RFEs. I think for that long a period of wait they have no rights to send RFEs, infact one should sue them. Delay has been from their side, and they expect the world to remain same - unchanged for ages, the job itself may no more exist in 5 years. Anyways, pls do post whatever RFE u get. BTW I am guessing you r in EB3 category.

I was shocked too, but hey after dealing with these people for so long time i do not get surprised any more.

FYI : I am in EB3 category.

Great ... so after all this wait .. and now an RFE.

Well .. the RFE

1> Marriage Certificate [if U are married]... then U might have to provide some other evidence other than the marriage certificate. Like affadavit from known persons. Joint tax returns or Joint bank account etc.

2> As it is long time since U have filled for 485 ... they may still want to verify the employment.

3> Tax returns they ask generally during the personal interviews.

4> Long time back .. unitednations had posted that .. USCIS might be still interested in 'ability to pay issues' .. even during 485 stage..

5> 485 RFE will come to you and/or Ur attorney.

Good luck and after U reply to the RFE ... U might expect the GC in about 2 weeks.

Usually 485 RFE will concern elements that are connected directly to the beneficiary's own biographic details - such as Birth, Marriage, Passport, Current Job, salary, any prior violations of status, security clearance etc.

As a result, 485 RFE's are always mailed to the beneficiary directly and perhaps in addition to that, to the lawyer as well, but that is not neccessary I think.

Also, I was once told that if u are in security check and thereafter you recieve a fingerprinting notice, then that event is an indication of the security check being complete.

Does that suggest that they are doing pre-Adjucation of 485 applications?
