LongGC - good news man...now u know the status of ur case..an RFE means the case is moving...and once u send them the packet..i guess it will be APPROVAL...

it is hard to make answer at this moment until you get rfe and know what they want! your new rfe will be the key, because it will reveal what this officer think about your case right now (not the officer one year ago).

i still strongly believe they just want to make clear about the period from denial up to now, once again, logically if they still focus on the "reason" they refused you one year ago or some "gap" caused by that denial, they would not issue this new rfe.

the officers are human beings too, they will let you go anyway. this time they maybe just ask some unrelated documents, like birth certificate or previous h1b or original i-94 ...

Your logic is good. I am also thinking of the same. One more reason they could have raised RFE (for silly things) is so that they get more time to act on my case. Remember that I was continuously following with Senator. At one point the officer told that he would give an answer within 10 to 14 days ( may have been tired of this continuous inquiries). Exactly on 14 th day he sent RFE. This buys him more time to work on my case or other cases. Now there is an obvious delay of mail, reply, ack and so forth. This RFE gives him at least a month before he can get back to my file again.

Anyway, something is better than no progress.

Today I got to see the actual RFE letter. It is for my company's ability to pay me salary.


It statesm "........ has the ability to pay the applicant's salary in addition to the salaries of any other employees the company has. The evidence submitted must demonstrate that the petitioner had the ability from the time the priority date was established until the date the applicant obtains lawful permanent residence. Evidence of this ability shall be in the form of copies of annual reports, federal tax returns, or audited financial statements."

I am submitting
1. EVL that states, title (same as LC), salary (not lower than LC), hire date, job description (same as LC).

2. Last 6 Pay stubs.

3. Company's Annual Report for year 1998 to 2003.

4. Company's Tax Returns for year 1998 to 2003.

5. Company's Audited Financial Statements for year 1998 to 2003.

(No. 3,4 and 5 are obtained from company's website and finance department).

How you all set up the e-mail.

uscis.gov's online status page now (I think, since last Wednesday) allows you to register your email to receive updates on your case per receipt #.

It was an RFE but it was a reply for my MTR. It states that by use of AC21 as suggested in August 2003 memo, they have ordered to remove the denial. However, they will aprove the case only if I am able to show them the documents. (which is no big deal). I already have the documents ready. Tomorrow I will ask attorney to mail them. He has the original copy and they have asked to include original.

You're really close now. Looks like the RFE was for simple docs and you'll be approved very quickly now.
