Got RFE. but.....

Hi, Ciba and my folks
I got a email from my attorney that he got my RFE(4/2/01) and
The RFE advises that all successor-in-interest cases are
being held in abeyance awaiting further guidance from INS headquarters.
(My Company merge, Jan. 2000)
and my attorney recommend filing new I-140 instead of waiting new guideline.
But what I cannot understand is DO I still need to redo I-140 even if
Companu Tax ID didn\'t change after Merger ?(Only name change)
If that is true, do I have to do wait long long time like new
brand new I-140 applicants ? or Is there any seperate channel CSC
handle ?
Please give me any advice.

hi, sorry to hear that. what is your ND/RD? how did INS know your compnay merged? you filed 485 after the merger?

Yes, Merger happened after my I-140 filing.
Here is my 485 dates
PD : 04/98
RD : 02/27/00 (VSC)
ND : 04/05/00 (transferred to CSC)
FP : 10/28/00
RFE : 04/03/01

frankly, if i were you, i\'d not to worry about it since you are bascially a free man based on 2045. it is just the matter of time for you to get your greencard. but i \'d say file a new 140 might be a safer approach if you want to speed it up since you never know ehn the ne regulation will be issued. the bottom line is that you are free to change job, to move around, which is good enough to me.

Hi jkwon,

CSC has been doing this RFE for a lot of folks whose company
have changed name, been bought out, etc. Since we don\'t know
how long it takes for INS to release long-awaited regulations, I
would suggest you go ahead and file a new I-140, which seems
to be very fast lately (about a few months).
