Hello,

I am in F1 visa in USA. I came in fall 2005. Since then I filled 1040EZ online for tax return. I should have filled 1040 NR-EZ, since I am a non-resident. Couple of days ago I got an economic stimulus payment. But I think that is for those who are residents for tax purposes. But I am not resident for tax purpose till 2010. So what shall I do now? Shall I file 1040NR-EZ for all those previous years and return this stimulus payment? Please give me advice.

Thank you for your time.

Are you sure you are not a resident for tax purposes? The USCIS and the IRS definitions of "resident" are vastly different. If you fulfill the IRS' substantial presence test, you are considered a tax resident.

I saw in a ppt file that for students with F1 visa it takes 5 years to be resident for tax purposes. I am sure about that. In that case what shall I do? I am in trouble?
any suggestion is cool.
