AC 140, got case # from Delhi

Hi,
Please help me, My case is registered & got case number but haven't got any indication about interview date.
How will I come to know about the interview date? Don't they give the interview date at the same time when they issue case number??

Please respond.

Thanks.

Assuming that both the regular NVC cases and AC 140 are
the same once the consulate enters them in their system,
it takes approximately 2 months for the appointment from
the date of entry.

Appointment month = month entered + 2 .

You will know for sure around the second week of a month
for appointments in the succeeding month.

Interview in January = You will know between 7th to 15th
of December.

DS-2002 Form

Thanks Raju for the information.
Please let me know if I have to send DS 2002 form for getting the interview date or they will be sending interview call letter irrespective of DS 2002(instructions for immigrant visa application). Please respond.
Thanks

You may be referring to Form DS-2001(formarly OF-169)
Instructions for Immigrant Visa Applicants. This is normally
sent out in Packet 3.

If your file has already reached the Consulate then you
may not have to worry about this. Non submission of this
form should not result in you not getting an interview date.

Thanks a lot Ashooash & Raju,
Probably, I didn't see your replies in other threads for same questions, Sorry for making you guys replying repeatedly....

I think, I have new question at this moment:
I am expecting my interview date somewhere in Mid Feb 2004, Please suggest & advice what docs I need to prepare well in advance, I mean which docs take long time to get?? Please correct me if I am wrong, I beleive, except PCC all other docs can be obtained within a period of 2-3 weeks before going to India.

Please suggest & advice any other precautions, tips which you learnt from your experience which you couldn't do but want to advice others?? Or which in any ways you want to advice from the point of view of documents / Travelling /Medical / Interview /Fee / returning back etc...??

Any help & advice will be well accepted & appreciated.

Thanks, Once again.

Thanks KD1403 & ashooash for the valuable information you have been providing.
Please clarify few more things about my case:
I have applied for AOS last year after getting I-140 approval but looking at long long waiting for AOS approval, I wanted to go for CP in Delhi. I sent AC 140 papers along with I-824 receipt (which my attorney filed while applying for I-140 last year). US Consulate Delhi registered my case & issued case number recently.

My question is do I need to send letter to BCIS (NSC) for withdrawing currently pending AOS application?? OR Can I keep both processes simultaneously??

Please advice to avoid any complications later on.

Thanks for your help.

Normally after the candidate has filed i-824 to change from aos to cp...the candidate normally gets a letter from bcis which asks the candidate to sign it and confirm that he/ she would like to change the process. This letter comes from bcis and aos process is considered revoked only when bcis receives such a signed letter. Ask your attorneys if they have received such a letter from bcis after filing of i-824?

jigesh:

i-824 receipt just acknowledges the receipt of i-824 form along with $$ on xx/xx/xxxx date. It does not state the reason for application of i-824. It is assumed that bcis knows the reason since they have received the i-824.

Jigesh,
I checked I-824 receipt, it just mentions $ amount & date as mentioned by KD...
KD,
As you mentioned I will ask my attorney, since initially I opted for AOS the same info must be with BCIS but I have applied for CP now, BCIS is not aware of that, I beleive. Am I correct? Legally, are we not bound to inform BCIS about change of process??

Thanks,

Happy holidays!

goyal, jigesh:

normally if one has opted for aos and then decides to change to AC I-140 by filing I-824 then:

1. After receiving I-824 receipt, BCIS sends the gc candidate a letter which the candidates needs to sign and rerturn confirming that he is ending his/ her aos process and continuing with his/ her ac I-140 process. Only when this letter is signed and received by bcis does the aos process get terminated.

2. If you have not received such a letter from bcis then you might want to ask yoru attorneys about it and consult.

What many folks do is they wait till they get their cp interview date and then mail the bcis letter informing on their decision to change from aos to cp.

Filing I-824 is INTENT to change. And signing the bcis letter and returning to bcis results into the ACTUAL change from aos to cp.
