Hi All,
Hope some of you remember,I had changed my job in march 2005.My old employer threatned to REVOKE my I-140,and he did.
I just received NOID and it say's that my old employer revoked my I-140 on april 25th 2005.
I started my new job on march 14th 2005.

Let me explain my case in detail now:

I had sub. labor. I filed for I-485 on march 14th 2003 @ NSC.
So Rightnow I'm on my 3rd EAD.completed 2 FP's.

I applied for FOIA in march 2005,but I still did not receive the labor partB,for me in order to send out the AC-21 letter(this was suggested by many of our friends here and my NEW attorney also).

I called my NEW attorney,but he's not available today(friday 29th aug).
So now what should be my plan of action.
I have my employment letter from my new employer, but its quiet general.

Can somebody send me the AC-21 LETTER FORMAT,AND ALL THE SUPPORTING DOC'S LIST FOR ME TO GET IT READY BY NEXT WEEK.

Please help/advice,

thanks,
Abhi

I-485 RD:March 14th 2003
FP1:April 28th 2003
EAD1:June 6th 2003
EAD2:May 18th 2004
EAD3:03/31/2005

Changed employer March 1st 2005

Letter from new employer with "new job title", "new job duties", "new salary" clearly mentioned. Also some explanation on company, # of employers, annual income, etc would help. Ideally the new job title and duties should be same or similar to ones on the labor.

Receipt Number for I-140 and the date it is approved. Get a printout from the website case status.

Letter from you/lawyer stating that you changed to new job, 485 is past 180 days, so you are eligible for approval as per AC-21 law.

Couple of Paystubs, especially if your company is small.

------

Frankly, you are not expected to have a copy of labor certification or I-140 approval.

Check with the Attorney what he needs to prepare the cover letter and also find out what documents he wants to attach along with that. you require to produce the copy of current employment letter (As specified in your sub labor) and salary details. Keep cool.. you should be good.

Did you see any change in LUD's or message, when you got the NOID? Also did your 140 message changed stating that 140 is revoked?

From what i have seen from the recent past postings.. Normally there will LUD Changes in some cases. But No Message change.

Hi Abhi485
Even you did not see any message change after revocation of ur 140 and also after ur NOID was issued? I am also in the same boat. I changed my jobs using AC21 and my old employer told me that he has revoked my 140 on July 1st. Eventhough my new lawyers have already filed AC21 papers and G28, I am expecting a NOID from USCIS, as they usually send the NOID without taking into account whether you have send the AC21 papers or not. Please let me know whether any message has changed in ur 140 and 485 applications?
Thanks
Kris2500

P.S. Thanks to vibrant for his comments

No LUD changes for I-140 (revocation by old employer)

Kris,
No changes to my LUD,and I had been checking my I-140 receipt #,everyday too.
Anyways my new attorney is getting all my documents ready, and my present employer is going to give me a EVL(the only problem I have is my job-title is different and pay is nearly 70% more).
My attorney said that should NOT be a problem for AC-21.
I'm hoping .I will not have any further problems.

thanks all for the support,
it really traumatising!!!:(

regards,
Abhi

My new lawyers said that the new job is to be similar and need not be the same. They are a big law firm and has many fortune 100 companies as their clients. So dont worry about it. I have invoked AC21 2 months ago too.
