Got laid off received Interview letter.

In interview letter, did they specifically ask for employment letter ? if not, then go to interview with all the papers that were mentioned in the interview letter. If interviewer ask for employment letter, then you can say, it is not mentioned in the interview letter .At the most, interviewer can send you back , asking you come back with employment letter. That gives extra time to find a job.

INS need employment letter which should contain hourly rate
and gross salary, last 3 years Tax, Passport and Driver license

When were you laid off ? I ask this because if your termination was recent (in December or so) you can just take your appointment letter and the latest pay stubs. This may be sufficient, or atleast will give you time as they may ask you to send latest paystubs or EVL later.

Remember, do the above only as a last resort. As a first priority try to find a job/offer of a job ASAP.

Try to get some employment letter from some desi company. If you know them usually they do that without problem. My friend did it the same way.

For your earlier posts it seems you were on 1099. But Please keep in the mind that to obtain GC you should be on W2.

You're lucky you have a backup plan...most of us do not. Is your H1B still valid? Worst case, if you get denied, then just wait until your wife files I-485, and you can be a dependant. You will get an EAD then also.

You still have 10 days left, so you might find a company to give you a job......anything IT related. Tell them its non-binding, and they can lay you off the day after you get the green card, if they don't really want to have you on payroll. You should write the letter to match your existing labor certification, even if the "real" job is not a 100% match. The lawyer should be able to help with this, if not FIND ANOTHER LAWYER NOW.

What does your lawyer say about the future employment letter format? You don't have much time to waste on this forum. You really need to get your lawyer working for you FAST!!

ur case atleast there is a case wherein u can move to her h1 and be on h4...but try some company and try to get a letter that is the best way to do it. offer them money to do it and many desis should be willing
 
Trying to help

You probably already tried this..... Ask your previous employer to reinstall you in the payroll, and at the same time you can agree with them that you are in a "Leave of Absence" so you are not physically in the office, and do not receive a salary, but you are still in the payroll.

Be sincere with your ex-employer and explain them how their decision is affecting your life, and how they can help if they reinstall you for few more days at no cost.

I went thru a lay off situation 11 months ago, but Jesus Christ kept providing for all our needs, and I recently received my I-485 approval.

Dear all great members need help

Today I received my attorney letter which states the required fees
for attending the interview in Dallas INS is $3150.00. Presently
I do not have job and do not know what to do. Do you all think he can play any mischief if I do not take him to INS interview?
 
3150 seems a **lot** to me. It is always advisable to have an attorney with you. However I would think twice to pay 3 grand. I don't think he can sabotage your I485. But he may not be helpful if you run into any issues.

My immigration Attorney is taking undue advantage since I emailed him I am currently Unemployed. I like to postpone my interview and change my attorney after postponement. The attorney is asking $3150.00.

If after postponement of AOS interview, I change my current attorney, is it possible my current attorney will be aware?

Please suggest.
 
I would think you current attorney would know you have changed representaiton if they try to check up on case and find they are not listed- you hav eto file the form to change representaion. I feel for you with this big charge for coming to your appointment- I feel my attorney will be doing same if/when we get interview as all my charges from him have been bigger than anyone else.

It is difficult to know what to do. This is a lot of money to spend, and I don;t know if it will help you.
 
My opinion is to take the interview now when you are out of job only for 15 days, and you can show the last paystub. You don't have to say that you laid off. You can say that you have been working so long, you have taken a vacation, in case if they ask are you still working :) But that's me. Its your life.

If you want to take a shot at the Green card, you can assume that you got 3k less salary last year :) Take it easy.

Be honest. Don't lie anything. You will come through...

This really might work. I remember my interview.....Officer asked for tax returns, EVL, EAD, new photos, and my passport. Never asked for pay stubs until my lawyer offered them. Most people get asked for their pay stubs, but you can say these are the latest ones you have.

The officer probably won't even think twice that you may have just been laid off, as long as you have the EVL with you. The signature on the letter is probably more valuable than the pay stubs, and he may never even realize that you don't work there as of last week.

Then again.....you're under oath at the interview, and the penalty for perjury....if they find out that is... is much greater than the penalty for not getting your green card, so if you're gonna lie outright, you better make sure that you got your ducks in a row first. Make sure you can corroborate your "lie" with evidence like a current letter or something from HR.
 
What is your lawyer promising you for the money he is charging you? Get the details, if you don't think it will help you, find another lawyer. Talk to people in your community to find a lawyer that will help you. There are a lot of lawyers, especially those who serve a particular community, like Indians, Chinese etc. that have contacts to get you a job fast. They will charge you as well, but atleast you know what you are getting in return. In the end its your call, do you think the money you are paying to a lawyer matters that much in the big scheme of things? Throw into the equation the fact that your wife has her own petition going on, so don't do anything you might regret later.

I will go ahead and get this out of my way for the following reasons:

  1. You have liabilities at your end.
  2. A bird at hand is worth two at the bush. At least this guy asks $3150. Is there any assurance that the next one you are about to hire will quote anything less? The more liable you are, the more people will try to rip you off.
  3. Postponing an interview may seriously jeopardize your prospects. For a moment keep in mind people like me, who are just being kept in the limbo without a call for interview. If such a thing were to happen to you, how will you make sure that your case is still being processed and not having been denied/closed as abandoned, etc.? Bottom-line: Local office is a mess and I would just try to get out of that mess.
  4. If INS were to agree to a change of date and quote 2/15/2005, say. How will that be of any help to you?
  5. You already have a plausible case for penalty of perjury because of the arrest record. You don't want to keep building liabilities to a point that no attorney can handle. So, the shorter and swifter the process is, the better you are. In other words, remove the liabilities, even it comes at a great cost.
  6. After you get your stuff, prefer a complaint to your State Bar against the attorney. He will have a tough time before the Ethics committee, which will be duty bounden to inquire into charges of price-gouging and will even be ultimately be able to return your fees over and above what was due to this poacher.

These are purely my opinions, which may not be the best. But then, I just gave you a different stab on the subject, of course, fully keeping myself in your position. If I were you, I would have done precisely what I have indited here. Good luck, dude.
