Hi All,

Here are my details

I-140/I-485 RD 10/29/2002
I-140/I-485 ND 11/26/2002

I-765 RD 12/11/2002 (I applied for EAD later)
I-765 ND 12/13/2002

My I-140 has not yet been approved.

My wife's details

I-485/I-765/I-131 RD 10/29/2002
I-485/I-765/I-131 ND 11/26/2002

We reached INS San Jose on Friday, 02/21/03 at 6:30AM. They opened doors at 7AM. Got in around 9AM(after waiting for 3 hrs in the cold outside....as there were close to 150 to 200 people before me) and got a number.

When we got in I found around 4 to 5 counters open and they were calling numbers at a steady pace. The INS guys took off for lunch around 12PM with only one counter open and didn't return until atleast 1:30PM . Seems to me like they work only till 12PM. After coming back from lunch they didn't open any more counters. Only one counter was still calling numbers.

My wife was past 90 days from I-765 RD(that would be on 01/29/2003) and I wasn't past 90 days from I-765 RD(that would only be on 03/11/2003....but I wanted to give getting my iEAD a try). I and my wife were given two consecutive numbers. We were finally called around 2PM. I sent my wife first since she was well past 90 days from I-765 RD. The INS officer just asked my wife our home address and granted iEAD to her. I was a bit tense when my number was called because I wasn't past 90 days from I-765 RD but I was past 90 days from I-485 RD/ND. FORTUNATELY, the INS officer didn't point out or bring up the issue that I wasn't past 90 days from I-765 RD and asked my address again and granted iEAD to me.

We were given iEAD's till 10/16/2003(7 months 25 days) and were out by 2:30PM.

I am not sure if one thing I did would have made a difference. For my wife I put I-765 copy on top of the I-485 copy. But for me I put the I-485 copy on top of the I-765 copy(since my I-485 RD is 10/29/2002 and I-765 RD is 12/11/2002).

I had a doubt regarding what would happen to the original EAD application. The officer said that this is only an interim EAD and the original EAD would be processed defintely before this iEAD expires.

One advice for anyone going to get iEAD(or anything) in INS San Jose. Try to go and stand in line around 5AM so that you may not have to wait till 2:30PM or so before you are out.

I will be happy to answer any questions you may have.

Regards
