Hi,

I got RFE which in addition to some specific points adds the general criteria required for qualification.
The specific they are asking is:

1) I had 2 patents authored with 2 other folks and they are asking about my contribution in that and it significance to the field? How do I show what is my contribution? To be true I was the one who worked on it and others had just their name added as part of organization process. It was funded by my company where I was working.
What other details do you all think I should add to support the importance of patent?

2) I also used the criteria of commanding high remuneration in comparison to others in my field. They are asking me to prove it? Does using the US salary average for my skill set will help or anything else?

Well i think is fairly simple.. areu using an attorney?
on the first one, you just have to prove that u did most of the work on the patents, simply get letters from people abroad of in your field supporitng your main contribution to the filed, saying how they used it in the field. Also you can send your paper work when u worked on the patent supporting your the main person.

On the second one is complicated, because it depends on the field and on your earnings, is better to use your attorney to answer this one.
good luck!

can you tell us ur Recived Date, Premium Processing date and any lud's?
thanx

Burden of proof

Dear shasta2005,

It is normally true that a patent is not recognized as powerful as a paper published in the peer-reviewed journals to prove one's scientific ability. Having said that, you would need to show that (a) the technology described in your patent is being currently used in the industry and (b) your company or others benefit from your patent. For example, you would need to say, "the production efficiency has gone up by 20%" or "the new technology has generated key materials of $200 million over the last two years". Good luck!
