Hi everybody, just letting you know that I received the courtesy copy of the approval notice on Friday. It says the original has been sent to my attorney. I should be getting it from him sometime this week. I will post the details after I get the passport stamping done.

Hi Kiran,
Congrats. I also have recieved approval for the I-140 filed through another company. If you remember, my original employer refused to process my green card any further. I have to give VSC a call and ask them what further action has to be taken.

Hi Kiran:

Congratulations on your I-485 approval. I am one of those unlucky guys, who happens to be in NJ and am going through the GC process with the regualr labor condition approval. My PD is December 1996. My ND for I-485 is August 2000. So you get the picture. Any way congratulations again. I have kinda given up on the situation in the sense that I have come to a point at which I am ready to take anything that comes.

The whole process has given me a lot of anguish and has eroded my married life. My spouse could not get her EAD until recently due to this nonsense. She being a professional had to stay home for five years (could not get an H1 in her field). She had to give up a lot of opportunities because she was not a permanent resident.

Any way, I hope for the best. I have to wait atleast an other year or so. I am sure I will get an RFE for employment letter (since my PD was December 1996). Any way GOOD LUCK in your future endeavor. Namaskara, Nanobba Kannadiga

I get the picture. I have faced the similar situation about EAD for spouse. But even after all the trouble I have been put through, I think I am still blessed when I see people who are struggling for food and basic education. God has taken care of all my basic needs. It is only the helpless feeling (due to employer taking advantage of the GC delays) that made me suffer. Now that my employer knows my 485 is approved, I have been getting a royal treatment. But I am going to just change job after sometime (once I get the card). Nannoo kanndiga. Ella olleyadagutte. Chinte beda. (Meaning for others: I am Kanndiga too, everthing is going to be alright, don\'t worry).

sorry to hear your troubles. but if you can just answer my one doubt, I would really appreciate it..
you said you are expecting an RFE since your PD is in DEc 96.. why? so, recent GC applicants (like me Aug 98 EB3) need not expect it?

If your case is old like ours by the time your application is adjudicated, then probably INS wants to check whether the job position which supports your GC application is still open. That does not mean recent applicants do not get RFE for continued interest in employement letter. Old applications normally raise questions in the mind of adjudicating officers.

Hi Kiran,
The I-140 redo in my case was in response to the RFE that they had sent, it has been approved now. At this point do I just wait for the approval of the I-485 or do I need to take any action, in terms of notifying the INS to cross reference the I-140 and I -485.

Any Input will be appreciated.

Have you sent back your RFE notice along with new I-140 ? If yes, then in my opinion you do not need to do anything. But if you just applied for I-140 and kept the RFE notice with you, then you need to send back the original RFE notice (which has a barcode that will associate your response to I-485) along with the new I-140 approval notice. If you followed the first method (sent back original RFE notice with new I-140 application) then you can call INS to findout what happened to your 485. If the IIO says they have received the response to RFE then you just have to wait. If they can not find new I-140, then you better talk to IIO about what to do. Also, if the RFE asked for an employement letter, then I assume you have provided one from the new company when you responded to RFE.

I used the first method, sent in the RFE notice with the I-140 application. The I-140 approval does have the beneficiary as the my self and also has the A# on it.

Hi Kiran:

Congratulations !!

I got Finger Print Notice and it is scheduled on Feb 28th. What is the process after FP. I don\'t understand what RFE mean? Does everu one has to get a letter from the employer in the RFE process?

Can I go to INS Office(Newark) prior to the appointment date and get the FP done as I won\'t have to cancel my plans of going to Atlanta for some class.

Thanks. Finally, it feels good to get the approval. But it is disappointing to hear it takes another 6 months to get the real card. I have seen some people getting it in two months which I think is okay. Atleast you don\'t have to scratch your head in front of the blood sucking employer and pray for his mercy.
