Hi ..

First of all I want to thank everyone who has helped me through this process .. sachinphadke, joef, tierdynamic and everyone who has helped me tremendously in this process. My special thanks goes out to sachinphadke who has more than helped me. He has assisted me and encouraged me through my ups and downs of this process and answered the silliest of questions I have asked him. I tip my hat off to him.

Also .. to those who are struggling with the same process dont lose heart or give up .. it is a pretty straight forward process and as long as you are in a real relationship things should work out fine in the end .. if you have time read the documents you file and do it yourself rather than using a lawyer .. this makes you more aware of the requirements and procedures to follow ..

To give a generalized timeline of my application process to you all ..

Applied for I-485, I-130 et. al on January 2nd

Got my I-765 aka work permit on March 7th

Got my fingerprinting done .. May 1st

Got my I-485 interview .. June 3rd

Didnt have my birth certificate so I took in today(June 4th) .. got approved ..

Things went really well for me .. I was extremely tense and nervous before the interview but the interviewer(s) were really nice .. and it turned out to be a pretty straightforward affair .. but then again .. it is better to be too prepared than under prepared ..

Anywayz .. if anyone has any questions feel free to ask me .. i will try upto my best to answer them ..

thanks once again to everyone who has helped me ..and best of luck to anyone who is still involved in the same process ..

USC Married to a H1, and ready to file for GC

I am a USC and married a H1 in 2001, She is still on H1 and working with the same company. I am ready to file for her GC. We have all her papers (Birth cetrificate, Passport, pay stubs, joint credit card accouts, lease papers etc) and we have a baby boy a year old.

We met in India in 1998 and married in a small Court ceremony in 2001 when she came to US on H1.

Now few Questions:

How long is the interview? and what is USCIS looking to confirm in this interview *marriage legitmacy only with general criminal background etc* ?

Does it make any difference if you were married in a Court setting in US, and not traditional Indian style (for indian couples) ?

Thanks

HI singhaj:

I think you should be alright as long as you have a residential lease and joint bank/credit card accounts. You should also have utility bills and other bill all coming to that one common address which shows that you have lived together. Pictures help to even though in my case it were not even needed. I had a court marriage as well in Dec. 2003 so I dont really think how you should have a problem because of that. I did however have joint bank accounts with my wife even before we got married. We have had joint accounts since 2002 even though we got married in 2003.

The interview itself should be no longer than 15-20 minutes. They will check for your criminal background by the FBI fingerprinting(I assume) and also will make you swear under oath before asking you about any criminal activities (do you plan to spy in the US, are you going through overthrow the Govt, are you in a terrorist organization etc. etc.) These are all routine questions that they ask.

I dont think you should have much problem despite of the court marriage. I had a court marriage as well and my interview went fine despite the fact. One piece of advice though .. try to send as much evidence as you can with the application. More is better than less.. atleast in this case.

Hope this helps.

Akshtray:
Could you kindly answer one question for me? When you got your EAD, did you give finger print? I was asked to give fingerprint on the day they gave me EAD card. I wonder if I need to print again before the interview. Thank you.

Hi purduecat:

Yes, you will be fingerprinted again. When you were fingerprinted on the day of receiveing your EAD it was only your index finger(or it was that way for me anyway). When you get fingerprinted again you will get all your fingers scanned through a machine in a 3D kind of way(again thats how it was for me). Anywayz .. hope this helps.

Married to USC AOS interview.

Hi Akshtray,
I too got married to a USC and came on k-3,and next month i have to appear for AOS interview, me and my wife have common insurance and staying together, she also got officially added my name to hers, but i was not aware of certain things like having both names on all utility bills iam now worrried how to prove that we are living together, ofcourse, after knowing we did open join account and added my name to hers on all utility bills this month by the time i appear for the interview i may not be receiving the bills on joint names.By gods blessings we are happily married couple. My question to you is:

Is it mandatory to have both of our names on all utility biils? What if we cannot produce?Apart from this we have all the documents?

Also plzzz if you 'd give any further inputs i'd about your interview i'd appreciate.

I'd appreciate your timely help.

devss

devss,
all you need is some proof of staying together. The main things are joint accounts, photos, common credit cards, lease paper or any letter from Apt office etc, utilities bills etc..

For ex if you have added her on your telephone bill, you can print the new statement online etc...

For us ,the office saw the photos, credit cards and apt docs.. thats it...

goodluck

Interview

Can anyone share their interview experience. I am waiting for our interview any week now.

We are married for 3 plus years and have one baby boy. She is on H1, and I am USC.

Besides "living together" things like (bills, common cards, life ins, lease etc), what else they are looking for?

Sinmghaj,

Could you please share your time frame (submit Application date to interview date) and local office from where you submitted your application?
