Got an RFE..Need Input please..

Here is some information related to my case.

Applied GC from NJ March 1998(EB3/Non-RIR),
Labor took 3 years to be cleared!!!

After a loooooong wait...got I-140 cleared.

Applied for I-485 in Nov 2001(RD-Nov20,2001 ND-Dec10,2001)
EAC0206xxxxx

I am with the same employer that applied for my GC now(Laid off and re-hired), but was out with a different employer before I applied for I-485 for 2-3 months.

Just got an RFE for current Pay stubs, (which I have) and for the employment letter(which I can obtain).

One concern is...since I was out of the company for a short while (2-3months), will this be an issue?

Any suggestions are appreciated.

All they need is the proof that you are still employed and the employer has the intention to keep you. You just need the current pay stubs and W2s. They wont even care about the gap.

You are good to go !

I-485 is future employment and already at this time you are working, I can not see any problem ! You may get your approval any day.

I strongly believe INS doesn't know any thing about whether you worked or not. As per your mail. You are still with same employer, who started your GC process. My take on that is send current employment letter and current pay stubs. You should be fine. Don't worry. You will hear good news soon.:)

Thanks to all those who responded. I mailed the required docs to the lawyer's office and they were mailed on Friday to INS.
Will let you know as soon as I hear from INS.

Don't worry about the gap. Just send the Paystubs and Letter from your employer. You will receive your approval Letter with in 15 business days from now. See my RFE date and Approval Date.

Relax, if they have asked for your paystubs and employer letter, that is all they are looking for. Don't worry about any work gaps. I am sure you will recv ur approval in another few days.
 
Hi , Could you please let us know

how many paystubs INS requested (in the RFE) ... and when was the gap in your employment.

In any case they dont keep track of your employment history.
So as long as you have the number of payslips wanted by INS without any gaps then you should be ok.

Finally the good news!!! Me and my wife's cases got approved on the 13th of May, 2003.

It has been a long wait 5 years and 2 months, and went through a lot of emotional and physical stress, but the Lord helped us through.
Sweet is His Promise, "I will never leave you nor forsake you"(Heb 13:4)

I got the RFE for the paystubs for the 2 pay periods and the employment letter. INS received the same on the 6th of May and the case got approved on the 13th of May.

This site has been a great support for me, and I know the people who are still waiting.....just hang on and dont loose hope, your cases will be approved soon and Good Luck to all.
