            Here is a good news which I wanted to share with you all. One of my friend who got his GC approved yesterday.
His PD was Nov\'96 and his RD/ND was somewhere in Aug/Sep. His employer is based in Pittsburgh. The interesting
part is his contract got over with his client withinr 2 -3 months immediately after filing his GC (I-485) and his employer
was not able to find a project for him. They told him to go on a leave of absence and they told him that they will keep
looking for him a project and if not they told him to even work for some company using his EAD. My friend did the
same thing. He started working for a company B using his EAD with the knowledge of his sponsoring employer
from Nov.99. During this period, he got an RFE for employment letter and I-140 Redo. His primary employer did
re-apply for his I-140, produced employment letter etc., to the INS and finally he got his GC approved. Unfortunately his
wife case has been transferred to the local INS and his wife has to wait for her final magic word. In this case he changed
his employer even before the new law which was signed by President Clinton on Aug. 2000. My friend told me that
he is going to work for his sponsoring employer atleast for a year as a goodwill note. I wish we all get an employer
like my friend who actually cares for their people. I wish my friend good luck and I hope he will get his wife\'s GC
approval soon. I just though I can share this info. with you guys. Btw, I am still waiting for my final word.

Dou you know why he got i-140 Redo.? is it because he change job or because of something else..

Congratulations to your friend, and hope that his wife gets her approval soon too, but I have the same question as Singha, why did your friend\'s employer redo the I-140????

His employer name got changed. It\'s not acquired by any other companies. It\'s just a name change.

As GC is for future employment, the new law does not come into picture. His GC is not going to be completed by a different company, it is the same company which says it would employ him once he gets his GC. I don\'t think new law is anywhere near this situation.

More than that why he needed to redo I140? I myself am not clear. By my thinking nothing persists for an I-140 redo, hope sam rajesh is in same tune. But as I said I myself am not clear.

I am in the same boat but haven\'t got FP yet. I was also got laid off in May\'00 two months after applying I-485. My employer himself told me that they are not going to cancel any ongoning process , and suggested me to take a new job using EAD instead of going for an other H1B, and if they have positions comes in between they would let me know. And even told me in helping me out at the approval time for any letter. But they didn\'t told me that they will consider me on Leave of absence. But after releaving me they paid me for two more weeks. Till now I didn\'t here any think from them for any positions. Ofcource I have taken an other job immediatly using EAD.

But I am still worried what could be happened when they request for REF and how my employer will react if I ask for it.

Ranjan, can you tell me, when your friend was told that he will put on leave of absence. Did your friend got any pay stubs without pay?

HI VSC_W, I"ll be in the same boat pretty soon with a little twist.

My details ( EB3_India, PD-12/97, ND-03/00, No FP) I"ll be laid off on March 31 or by April 2nd week. Even though my employer is cooperative in various cases, I think they might dissolve the company by May-June timeframe.

God forbid if I were to get the RFE after the company is dissolved what are my options?

Sam Rajesh,
did your friends\' wife\'s case got transferred to local INS at Pittsburgh? Would you be able to get some information regarding the interview experience at Pittsburgh INS? My case was transfeered in 2/01 to Pittsburgh INS.
