I think it'll be easy to downgrade as there are no risk involved as compared to EB2, If they start doing it just think about it, EB3 will be in deep shit.
 
All they have to do is just send a letter to USCIS right? This US immigration is deeper than black hole. Did not thought of it...

I think they have to refile I-140. And it's pointless to move anyway, what if EB3 goes back to Jan 01, 99 next month? PD movement is hardly predictable.

Buddy never say that. be positive, we have been in between April 01 and May 01 2001 for 3 consecutive years. you still want to wait, good that people converted from EB3 to EB2, now we have some kind of hope to move forward.

May be we all can put effort and find ways to inform USCIS about stopping this conversion process like banning labor sub.

Thanks for injecting some positive thoughts here. I didn't really mean to imply that the dates actually could move that far back... I was only trying to make a point.

labor sub has already been banned, so hopefully things will stop getting worse from here.

I have not seen any EB3 approvals from beginning of this year...(or did I missed..) yet why did not CIS moved the EB3 dates forward? hope they move 2 years in next bulletin.
 
All the dates will be current once Congress meet to welcome new president. Right now Republicans have no agenda but to attack Immigartion issue because they failed on everything they thought they can accomplish. So new president knows he has to solve this mess or he will not be elected next time and his party will loose too.

So guys by the end of 2008 Most people who been waiting for long, their misery will be put to rest once in for all. If not Bill Gates and Warren Buffet will buy house in India, China and ROW and run their IT business there. Coz it is affecting them on their business and it was an evident on PBS couple of Months back when both guys were ask about H1-B and Green Card Backlogs. They mention the difficulties they are facing with the stupid rules put by Goverment of United States.

If they continue to put pressure on the government, they will get some additional H1s. But I doubt Gates or Buffet seriously care much about the EB based GC backlog. All they care for is for their work to be done.

Someone coming for the first time on a H1 will not look at the GC backlog before they make their decision to come here. As long as that supply of H1 personnel remains in tact, the US legislators and companies can get away with not doing anything to remove the current EB GC backlog.

Will there ever come a time when a major company takes its entire business offshore and give labor shortage as the reason for their action? That will force the legislators hand.

The talk of "baby boomers retiring over the next few years and thereby causing shortage of workers" does not sit with the common man who does not have the vision to see that much into the future. There are only few who see the long term effect of such shortage. The senators/congressmen need common man's support more than the few who see the long term shortage.
The same goes to the "effect of Blue Card" or any such competition from the rest of the world for skilled workers. Only a visionary can see the potential impact in the long run and will take remedial steps now rather than later. But unfortunately there are not many such people who can force the legislators to take action.
