Any one interested to come with specific question to get clarification from them, please plan to attend seminar and it's FREE!! We about 25 members from all nationality (open for all nationality!!) are planning to talk to the director about huge backlog of EB I-485 transferred cases at Atlanta local office. Please bring your I-485 receipt copy and see me (immigration portal group) at the seminar. We are planning to handover 2 page summary (highlighting backlog issues only at Atlanta local office providing statistics and comparison with other surrounding local office like NC., hardships, pilot program of I-485 approval in 90 days at Dallas/Miami/LA and about infopass program) along with everyone's I-485 receipt copy.

Any one interested, please post here nice 2 page impressive summary letter here. We will select best letter and hand it over to the director.

Please provide comments, suggestions, critiques to improve the content and strategy. I plan to bring this to the May 16 event and hand over in person. It will have a table at the end for us to sign and provide case specific details.

Draft:

The undersigned applicants for Adjustment to Permanent Resident Status have filed I-485 applications with various CIS Service Centers after the approval of individual Immigrant Petitions for Alien Workers in the employment-based category. The I-485 applications have been initially processed by the CIS Service Centers and transferred to the Atlanta Local Office for conducting interview and/or complete the final processing. The application filing dates, receipt numbers and CIS file numbers are shown in this letter.

As you can see, many of our I-485 applications were filed more than three years back and the application priority dates are even older, in some cases exceeding two years prior to the I-485 filing date. Thus, some of these applications have been pending for five years or longer based on priority dates. The continuation of pending adjustment of status is causing us significant hardship as described below.

As most of us do not have any other status that would permit employment authorization or international travel, we must obtain employment authorization and advance parole for international travel each year at a significant out of pocket expense. Since the processing fee for these documents were increased beginning this month, the future renewal of these documents will involve even greater cost to us. Due to the unpredictable processing times associated with the renewal process, there is a potential for a period in which we may not have valid employment authorization or international travel document, thereby affecting our employment and professional career as well as our social life.

Our pending adjustment of status is also affecting our spouse/children’s education. Although, all of us have been residing in Georgia for a long time (in some cases more than 10 years) and have been paying Georgia income tax, our spouse/children are unable to qualify for resident tuition in colleges and universities under the University System of Georgia and the economic impact of this is very significant. This is avoidable by completing the processing of our I-485 applications.

Some of us have also applied for home loans and either have been refused or charged a much higher interest rate due to our pending adjustment of status. As hard working legal US residents and regular income tax payers we are entitled to equal treatment for credits, however, the pending I-485 applications are depriving us of this entitlement.

Based on the current processing date reports published by the Service Centers where the I-485 applications were filed, most of us would have enjoyed the privilege of permanent resident status except that our applications have been transferred to the Atlanta Local Office where they have been pending (in some cases exceeding two years). Some of us have specifically inquired about the schedule for the final processing of our I-485 applications at the Atlanta Local Office in person, but were not provided any relevant information. The status quo on this very important matter (i.e., the final processing of I-485 application) is extremely frustrating to us and we feel we have a right to know specifically when the Atlanta Local Office plans to conduct our interviews and/or complete the adjudication of our pending I-485 applications.

We urge you to prioritize the processing of our applications. We believe our applications are complete and otherwise approvable except that they have been set at a low priority. Due to the financial impacts and the emotional uncertainty these pending applications are causing us, we would request your immediate attention to our case (failing which we would resort to take our case to the US Court System??).

My comment: Our main goal behind this letter/meeting is make a humble request to clear all the backlog, so we have to show humbleness only in the letter and would like you to remove any sentence that upset them and make matter worse like others are saying to take this portion out of the last sentence ‘failing which we would resort to take our case to the US Court System??’.

Since by reading they will only clear backlog of I-485 case pending over 3 years and it won't help to anyone whose case is pending over 1 year and got transferred. I think, you can highlight the fact that most of us filed I-485 after I-140 approval means waited for I-140 approval for over 1 year and now waiting for I-485. These applicants even didn't get benefit of concurrent I-140 and I-485 filing which others have and they don't have to wait for these long for both I-140 and I-148 to get approval.

I also would like to remove this part "and we feel we have a right to know specifically when the Atlanta Local Office plans to conduct our interviews and/or complete the adjudication of our pending I-485 applications". Since your next para after that will create very good impression.

Also, please highlight each hardships point with the bullets to create good impression.
Add point on multiple EAD, AP and fingerprinting and point of ‘Victimized by the inconsistent policy/rule of Atlanta local office for issuing interim EAD before 90 days. Atlanta local office is denying request to issue interim EAD after expiring before 90 days where as Charlotte, N.C. is issuing interim EAD before 90 days.

Also, I would like to correct this sentence 'We urge you to prioritize the processing of our applications' to 'We all urge you from bottom of our heart to prioritize the interview/processing of our applications'.

Also, please add comment about Infopass and pilot program at other local office. Also, provide statistics of Atlanta local office processing along with comparison of other surrounding local office like NC. Here is that statistics (thanks to member ‘Cherokee’):

I think the letter is good except for the part "failing which we would resort to take our case to the US Court System"

Also, does this letter apply only to those whose cases have been transferred to the Atlanta office?

Dear Friends:

I am very much still here with my petition pending at Atlanta office for interview. However, I am seriously hamstrung in participating on direct action such as these or even participate in this forum, because, these days I am geographically located to Canada from where I am caught up with work related stuff. Therefore, I am watching all your efforts with very little participation from my side. Please keep us informed if anything panned out of these meetings. Good luck.
 
Meeting Update

The event was somewhat disappointing as the District Director did not show up (before we left) and only a handful of us (applicants) were present. The focus of the event was to discuss various nuances of INA. A practicing attorney and a retired CIS employee were the speakers and they took a lot of questions from the audience, free of charge.

We handed over a letter with copies of receipt notices of I-485 applications to one of the speakers. Today, I confirmed that this letter found its way to the District Director (who eventually showed up later that evening, she was stuck in weather related traffic/accident and could not make it tot he event on time).

As discussed during the event, we need to pass on a copy of the same/similar correspondence to the Community Relations Officer in Atlanta. I suggest, we all gather at our traditional meeting place (Global Mall) at a convenient time to figure out the path forward. We may even request face time to visit the district director.

I think, the event was more disappointing as only 7 applicants showed up for the event even though it was on Sunday and free (free food/drink prize also). Everyone wants their application get approved sitting at home, asking status/questions and let others do these kind work. If applicants are not interested then what can we expect more from the District Director.

I greatly appriciate victim1084 effort/time in doing wonderful work here.
