The undersigned applicants for Adjustment to Permanent Resident Status have filed I-485 applications with various CIS Service Centers after the approval of individual Immigrant Petitions for Alien Workers in the employment-based category. The I-485 applications have been initially processed by the CIS Service Centers and transferred to the Atlanta Local Office for conducting interview and/or complete the final processing. The application filing dates, receipt numbers and CIS file numbers are shown in this letter.
As you can see, many of our I-485 applications were filed more than three years back and the application priority dates are even older, in some cases exceeding two years prior to the I-485 filing date. Thus, some of these applications have been pending for five years or longer based on priority dates. The continuation of pending adjustment of status is causing us significant hardship as described below.
As most of us do not have any other status that would permit employment authorization or international travel, we must obtain employment authorization and advance parole for international travel each year at a significant out of pocket expense. Since the processing fee for these documents were increased beginning this month, the future renewal of these documents will involve even greater cost to us. Due to the unpredictable processing times associated with the renewal process, there is a potential for a period in which we may not have valid employment authorization or international travel document, thereby affecting our employment and professional career as well as our social life.
Our pending adjustment of status is also affecting our spouse/children’s education. Although, all of us have been residing in Georgia for a long time (in some cases more than 10 years) and have been paying Georgia income tax, our spouse/children are unable to qualify for resident tuition in colleges and universities under the University System of Georgia and the economic impact of this is very significant. This is avoidable by completing the processing of our I-485 applications.
Some of us have also applied for home loans and either have been refused or charged a much higher interest rate due to our pending adjustment of status. As hard working legal US residents and regular income tax payers we are entitled to equal treatment for credits, however, the pending I-485 applications are depriving us of this entitlement.
Based on the current processing date reports published by the Service Centers where the I-485 applications were filed, most of us would have enjoyed the privilege of permanent resident status except that our applications have been transferred to the Atlanta Local Office where they have been pending (in some cases exceeding two years). Some of us have specifically inquired about the schedule for the final processing of our I-485 applications at the Atlanta Local Office in person, but were not provided any relevant information. The status quo on this very important matter (i.e., the final processing of I-485 application) is extremely frustrating to us and we feel we have a right to know specifically when the Atlanta Local Office plans to conduct our interviews and/or complete the adjudication of our pending I-485 applications.
We urge you to prioritize the processing of our applications. We believe our applications are complete and otherwise approvable except that they have been set at a low priority. Due to the financial impacts and the emotional uncertainty these pending applications are causing us, we would request your immediate attention to our case (failing which we would resort to take our case to the US Court System??).
