Going to work in US and planning to apply Canadian Citizenship

Hi guys,

I have a couple of questions on Canadian citizenship application.

I landed with PR in Nov. 2001, and then have been physically staying in Canada most of the time up to now. I recently got a US job offer, and will move to US this August on H-1B.

1. I know I am qualified for the citizenship application. Should I file my application from a Canadian address before I leave? Can I file a citizenship application later from a US address after I settle down?

2. My wife is a Canadian citizen. If she moves with me to US, then my PR should be always fine, right?

-- File it using the cdn address. The CIC does not entertain the foregin address for citizenship. Their 1-888 number is also not accessible from the US. If you want your application to proceed smoothly and if you have completed 1095 days of physical presence in Canada in the last 4 years (not from 2001, but from 2002), apply for citizenship using the canadian address.

2. My wife is a Canadian citizen. If she moves with me to US, then my PR should be always fine, right?

-- This is not true in your case. The law says that you should accompany a cdn citizen spouse. In your case, you have a job and your cdn spouse is accompaning you. Therefore, do not rely on this fact. Apply for citizenship if you are eligible. The process will take 1 year to complete and your PR status will be fine during that 1 year...

Thank you so much for your valuable information. Just one more question, if my wife (cdn citizen) also finds a job soon in US and works on TN or H-1B, am I eligible then to be considered as "accompany a cdn citizen" to maintain my PR status?
 
If you move to the states and you would tell postcanada to send your email of your CDN address to your US address, anyone knows what is the delay? cause i thought of doing this but i am not sure if i would get my test letter on time to travel !!

As far as possible, avoid this status where you want to be considered as "accompanying a cdn spouse". Because they are going to find out whether you are "just accompanying" your wife or not. As soon as they find out that's not the case (in case you both are working on independent visas), there are going to be more questions and the situation might turn ugly.

Remember, this law is for people who need compassionate grounds and not for convenience - which is just to maintain the PR status as an insurance policy - cdns do not like it. That's why, do not rely much on this law.

Sometimes, the CIC does not give sufficient time for the forwarded mail to reach its final destination. If this happens for your oath, you are "done" - and will create a mess. Give a cdn address to avoid any future issues.
